A McDreamy Demonstration of Fair Use

Have you ever wondered what “fair use” actually means?
You’ve probably heard the term bandied about when it comes to copyright and to using clips in your YouTube creations. But now that a federal judge has ruled on fair use, we’ll show you in this week’s New Media Minute what fair use means what it comes to images of the TV star Patrick Dempsey.
But there’s more fun stuff in this week’s report. You know those really annoying ads that run online in front of your favorite Web programs? Well, pre-rolls aren’t going away anytime soon, but they might get a little less annoying.
You’ll also learn about how the online video programmer HealthiNation is selling ads in an innovative way.

Not a big fan of pre-rolls but they are a necessary evil. Though a little less evil when shorter! Great Vid, Daisy!

Pre-roll just doesn't work. We've all been trained to ignore ads when they're not relevant or when they're placed in exactly the same place every time. Advertisers need to re-think the way they're trying to get my attention.

Overlay ads with close buttons make the most sense to me. Uninterrupted video, more ad spot potential, and users can quickly close ads that obscure their experience. However this is best for branding and not hard sell, since users are engaged by the video and wouldn't typically depart to follow a link.

Kudos on the video Daisy. I think brands will get more out of the pre-roll using shorter, more impactful spots. To me 5-7 seconds is enough.

I think it's important that someone has finally addressed the fair use problem legally. Sure, trying to pass someone's entire work off as your own isn't so fair. But, sharing small shots of Mc Dreamy should always be fair. :)
While the one using content should consider if the way they are using it is fair, it should also fall to the original creator to consider the use before issuing a take-down notice.
I hope this leads to a lot more creativity in the online world.

Pre-roll is just a space of time, its upto the admakers to fill it with good content, why don't the advertisers ask viewers to create ads. BBC3 are doing it for inerstitials for broadcast, has the old media beat new media here?

Daisy is great. The energy, insight, and humor make NMM and TWIM 2 of my favs.
I'm glad to see a judge favor fair use though I worry that his ruling has little to no teeth so it may be ineffectual.

There is a certain irony that it's cheaper to keep these longer ad segments alive on the Web than to cut them down to consumable bites. It's great to hear that savvy companies are committing funds for online ads of appropriate length. It's been a long time coming. --Love the t-shirt Daisy!!

Very interesting on fair use..but I love the outtakes, theys show how hilarious you really are! as for ads..the companies (such as maniaTV and Heavy) delivering branded entertainment are best equipt to monetize content without scaring off the viewer.- i too love the t-shirt.

Pre-roll ads are annoying...but at least we're still getting to view the video on demand. They've never deterred me from watching a show online.
