Jan Crawford Greenburg is a correspondent for ABC News' bureau in Washington DC. She covers politics, the Supreme Court and provides legal analysis for ABC News. She is a graduate of the University of Chicago's law school and is a member of the New York bar.

Legalities is in session...

Welcome to "Legalities"! I hope you'll log on regularly to read posts about my thoughts on life, law and football (depending largely on the success or failure of the Crimson Tide's new $32 million man, Nick Saban).

...to sitting in the middle of a lively debate between Justices StephenLivelydebate_7 Breyer and Antonin Scalia over the role of the Supreme Court and interpretation of the Constitution  (Breyer v Scalia)...

Greenburg_book_4Starting Sunday, Jan. 21st, I'll be out hawking my new book, "Supreme Conflict: The Inside Story of the Struggle for Control of the United States Supreme Court"  when I appear on ABC's This Week with George Stephanopoulos.  I spent much of the past year researching and writing "Supreme Conflict" and on Tuesday it will officially hit the bookstores thanks to the efforts of my publisher and editors at Penguin Press. You can read a blurb here about Supreme Conflict, or get a peek at what I've written by reading my answers to five questions Howard Bashman posted on his blog, How Appealing. Also on Sunday, look for my article about Supeme Conflict in the Outlook section of The Washington Post.By Monday, I'll be in New York for an appearance on ABC's Good Morning America and that night watch a special report on Nightline about one of the most revelatory chapters in my book.  But more about all of that as it happens, right here in this space.

From one Supreme Court/Crimson Tide junkie to another, welcome to the blogosphere. The Roberts, Scalia, Stevens, and Breyer interviews would pale in comparison, of course, to a one-on-one with Saban.

Has "Supreme Conflict" been released nationwide? I'm not sure if you're aware, but the book has been available in Hawaii for two weeks or so.

In any event, I really enjoyed it. After the first few chapters, though, I rated it average or slightly above-average in the SCOTUS canon. However, after those chapters, the book is really good. Congratulations.

I would like to know where the separation of powers comes into play here? Why is it the supreme court now rules our country, and even tells the president what he must or must not do reguarding his presidential responsibilities? Aren't there some kind of checks and balances to prevent this kind of thing? Where is the respect due the President of the United States, as President? How do they think this makes us look to other countries? Do they think making this look like a bad thing, looks good on us? Why is it we hear nothing of any possible Republican candidates? Some are not so easily brainwashed, However, obviously some are. I hope winning is worth us looking like fools to the rest of the world.I hope winning is worth desroying our credibiliy in the rest of the world;and the SAFETY in OUR world.

I've appreciated your work in its many forms, whether from your days at the "Chicago Tribune" or at "The News Hour" on PBS, in which you provide much-welcomed comprehensive background and explanations about the Supreme Court and its decisions. I was saddened to see your departure from the "Tribune," fearing I'd lost one of the few reporters who make coverage of the Supreme Court interesting and understandable. So, I was very pleased to see you appear on ABC News as a legal correspondent and analyst and I look forward to reading your book and your blog. Keep up the outstanding work in explaining all of those legalities to us laypeople!

Re today's WSJ column about Clarence Thomas. The problem with Clarence is that he is literal to the point that many of his opinions lack common sense. They read well from the viewpoint of the strict constructionists and that's why Scalia and occasionally Rehnquist joined them, but often the results are absurd. Read Thomas in the "Wilson" case and then read Breyer's dissent. Sometimes when the intent of Congress was clear but the law imperfectly crafted, common sense has to prevail if justice is to result. Thomas too often lets his rigid ideology and penchant for perfection in the use of the English language get in the way of the soul of the law, fairness and justice.

We are reaching out for your assistance for coverage of our story in which horrified my entire family and especially my grandchildren, whose little spirits and minds are so broken. In which a powerful government did to crush their small souls into fragments of little pieces of mistrust of all white people, especially white Police Officers. The Wyandotte County, Kansas City, Kansas Unified Government, and it’s Police Department has done so unjustly and inhumanely to our family.
There also was a story covered by ABC WORLD NEWS about the pregnant woman, done by ANDALE GROSS, who was stopped by the Kansas City, Missouri Police Officers, while she pleaded with them to understand that she was bleeding due a pregnancy difficulty, is one of thousands unheard over the decades in the Kansas City Metro area.
In particularly, on the Kansas City, Kansas state-line side of this twin city area. Wyandotte County Kansas Unified Government and its court system, Police Department, are in most part, a discriminatory and bios system of racist due process of the law. Please consider this story , consider this family who stands no chance at being heard,

A complaint was file with the U.S, Dept of Justice Special Litigations Section, in Washington D.C.
A complaint was file with the local FBI Office in Kansas City, Missouri.
A complaint was file with the U.S. Attorney General’s Office, Gonzales.
A complaint was file with the Kansas City, Kansas Police Department Internal Affairs

On November 18, 2005
Our family went to all the neighbors on our circle closed ended street at 5626 Crest Drive in Turner District of Kansas City, Kansas, to get approval that we would be having a birthday party for my grand daughter, Tyiesha Jennings who had turn 18 years old that day. A gathering of teenagers to socialized, no drugs, absolutely, and no alcohol, period. Not even so much as a cigarette would be permitted on the property, let alone, in the house. Because of we all belonged to the Church of God in Christ organization. We believe in doing things not only righteously, but legally. However, because we are Black people, our sign of Christianity was not as prevalent as our sign of our skin color.
The neighbors had no objections to the party. On that night there were no loud music playing, no hanging out in the yard, everyone in the basement listening to a small 16 inch by 20 inch radio/CD player that could not produce enough sound for them to hear the music from their talking and conversing. Yet, everyone, I mean one of them were behaving accordingly to my wishes and instructions. No Alcohol or drugs permitted. I, Gerene Hamilton, and my Husband, Bobby Hamilton, Tyeisha’s grandparents were chaperoning the party, alone with my older daughter, Vicky Everidge and her boyfriend, Avery Verser. Were all adults present and chaperoning the party. When all of the sudden about 10:30 pm on that November 18, 2005 night, five white Police Officer forced open our back basement door where the children were, and demanded that “This Fucking Party is Over” and “Everybody Out“ They forced their way into our home, with total disregard to our constitutional right of unreasonable search and siege and confiscation of our property. They were demanding that we all leave and never asked for the home owners, or an adult.


They struck my 14 year old grandson in the face with their fist, causing a black-eye, for standing over his mother they pushed to the ground (Officer Hamilton & Wilcox) and the hit him in the back of his head with a flash-light and told him to shut up you Pussy! Called us Niggers over and over. My husband, Mr. Hamilton asked the officers was that necessary to call these children Niggers, they told him to go back up stairs Nigger and began to Pepper Spray him and all they children there, and my 13 year old honor student and valedictorian two years in a row, grand daughter was slammed against the wall of the basement and hit in the mouth with a flash light and arrested, with her brother. De’Angelo and Victoria Everyidge. These babies are scared for life because of the racism and hate filled Police Officers permitted to serve and protect our communities. .
They pointed lazar beams on all the children (Stun guns)
Arrested the children’s mother, Vicky Everidge, the birthday girl Tyisha Jennings, charged her with possession of marijuana they claim they got out of back seat of the potrol car they put her in when they stopped a dark city park with the children and young adults they arrested for asking them why are they doing this.
They arrested Deangelo and Victoria Eve ridge * Assaults on a Police Officers & Resisting Arrest
Avery Verser for telling them DeAngelo is only 14 years old, why hit him? Obstruction of Justice.
Tyeisha Jennings for a Assult on a Police Officer & Obstruction of Juctice
They took the Juveniles 13 year old Victoria & DeAngelo Everidge and Avery Verser and Derick Folson and Tyisha Jennings To the a dark City Park for 35 to 40 minutes to laugh & discuss how they were going to collaborate their story. They transported Tyeisha from the Police Van to a Patrol Vehicle and then after 30 minutes of being there they took them to jail.
14 year old DeAngelo Everidge had to be taken to KU Medical Center to be treated fir his injuries inflicted by the Police Officers, yet he was arrested and jailed in Juvenile Detention with little Victoria,
They Held 13 Year Old Victoria Eve ridge & 14 De Angelo Everidge for 4 days
Refused them any visitation by clergymen, family members, attorney, or their own mother.
They Striped Search the Juveniles ( DeAngelo & Victoria) and Cavity Search their rectums and Victoria’s virginal area.
Held for 4 days * until a white neighbor (Tonya Rhymes) begged the Mayors secretary
(Mayor Joseph F. Readon) to order the Detention Center to let them go. They Never Charged either Juvenile with the chatges they were arrested for. But why were they illegally held for 4 days.??
Do African American have heirs to the constitution of the United States?
Our 1st Amendment & 4th Amendment Rights were blatantly violated.
The Judges have ruled that all the children & young adults are guilty as the Police charged them. And that the Police Officers have conducted themselves lawfully and accordingly to the “Color of Law”
A big slap in the face to the African Americans under the Constitution of the United States as heirs to these fundamental rights. We have court transcripts of the Police admitting they had no probable cause to force their way into the back door of our home and tell our guest to leave, and call us Niggers, Black Bitches, Pussy’s, and shut the fuck-up!

FBI ends probe into racial bias complaint
The FBI says witnesses in the KCK incident won’t cooperate.

The FBI is preparing to close an investigation into a racial discrimination complaint against two Wyandotte County law enforcement agencies, because the accusers declined to cooperate.
“Our investigation is in the process of being closed, pending a final decision by U.S. Department of Justice officials,” said Jeff Lanza, an FBI spokesman.
The people who made the allegations would not agree to be interviewed, Lanza said.
The complaint involves the actions of about 20 Kansas City, Kan., police officers and six Wyandotte County sheriff’s deputies who broke up a Nov. 18 party in the 5600 block of Crest Drive in the Turner area.
Officers responding to a noise disturbance call at the house found more than 30 persons, including teenagers, celebrating an 18-year-old’s birthday.
In breaking up the party, the officers allegedly used excessive force and chemical spray while uttering racial and sexual slurs against the black partygoers.
Police Chief Ron Miller said the department had reinitiated its investigation to ferret out exactly what happened that night.
Police have taken statements from officers involved and had limited cooperation from people involved with the family.
