Recount Flashbacks

May 22, 2008 2:08 PM

I've been thinking a lot about the Florida recount lately.

Long before Sen. Hillary Clinton, D-NY, went down to the Sunshine state yesterday where she invoked that tumultuous battle from eight years ago.

(Watch her HERE or read about it from ABC News' Eloise Harper HERE.)

Many of the themes from that contest have been repeating themselves in this Democratic contest.

We have the notion of a popular vote victory versus delegates (or electoral votes, in the case of Vice President Al Gore).

There are debates about which side is more ruthless, more willing to say and do anything to win.

We have accusations of one side trying to "steal" the political crown from the other, and long conference calls where reporters sit on the other end wondering how the political operatives can keep a straight face as they contradict statements they made just a day or two before.
**
A few weeks ago, at a screening for the new "Recount" movie, which will air on Sunday on HBO, a Republican who was involved in the 2000 struggle on then-Gov. George W. Bush's side likened Clinton's strategy -- her new delegate math, popular vote argument, push for Michigan and Florida to be seated, etc., etc. -- to the way he thought Gore's team tried to "change the rules in the middle of the game" during the Florida recount.

As author of a book about the Florida recount I was asked to consult with the producers and writer of the HBO "Recount" movie, which meant that I read some early drafts of Danny Strong's script and watched an early cut of the film, offering my suggestions to Strong and the production team, including the splendid Paula Weinstein.

The film is not perfect, but it's very entertaining in my (clearly compromised) opinion. And given Hollywood's generally liberal leanings, it was fairly balanced.

Which is not to say it was balanced. While the Republicans are treated fairly in the film, any movie has to have an emotional center, and in this case they chose Ron Klain, the head of the Gore team.

That decision, perhaps understandable given the dramatic arc of the Gore-Klain relationship, does tilt the film to the left emotionally, if not intellectually. Film, of course, is a highly visceral medium, so some viewers may get caught up in the "count every vote" rhetoric with the score swelling beneath it and not be as impacted by the fact that the film points out, several times, that the Gore team never actually tried to count every vote, but rather attempted to pick off four Democratic-leaning counties.

There are other editorial decisions I disagree with but generally I agree with Bush lawyer Ben Ginsberg, portrayed by Bob Balaban in the film, who gave it a generally positive review, writing in US News & World Report: "Republicans won the recount. Democrats won the movie. This should not surprise us. That said, HBO's two-hour Recount does a terrific job of accurately capturing the tension both sides felt during those wrenching 36 days and conveying how rapidly and unpredictably developments came at us. It is an exciting story that will rekindle memories none of us who were there or were following at home will soon forget. Recount marshals these events into a well-done, well-acted, and entertaining movie."

The performances are very engaging -- Kevin Spacey as Klain, Tom Wilkinson as James Baker, Laura Dern as Katherine Harris -- and the casting was excellent.

(I made one casting suggestion during the production process. For a scene where Joe Lieberman's voice can be heard on a conference call, I recommended that the producers get the guy who played the dad on "Alf," since he and Lieberman have the same voice. Alas, it was not to be.)

The movie has already experienced some controversy, with former Secretary of State Warren Christopher objecting to his being portrayed as rather effete and weak.

That part of the script Strong based on another book, and the idea that Christopher was weak right out of the box does not square with my reporting. In fact, for my book I had contemporaneous notes taken at that first meeting Christopher had with the Democratic lawyers in Florida, indicating that contrary to the other book, Christopher was interested in pursuing lawsuits on both the state and federal level, and was quite intrigued by the butterfly ballot problem.

However -- this is a movie. There were two U.S. Supreme Court cases in reality; only one in the movie. I share the general view that Christopher was not the best match for Baker, and he like many Democrats was ill-suited for the task. Which by the way may not be a criticism of his character. That was some nasty business down there.

Watch the film Sunday and let me know what you think. I predict most of you, if you're political junkies, will enjoy it. No matter what you think happened down there eight years ago.

I was there, I lived in Tallahassee in 2000. Scary thing to watch democracy cease to exist. But here's a few other things to consider.

Does anyone know about Govenor Bush calling for the Florida Highway Patrol do perform a routine license check for all the cars travelling south from Tallahassee? Crawfordville Highway and Wakulla Highway, two lane roads which many people who work in Tallahassee were driving home that night, attempting to get to their local polling place to vote only to find themselves in traffic which denied them the chance to vote.

Does anyone remember Katherine Harris's statement? "They (the counties trying to get the votes recounted) should know and follow the rules of the election. Followed two years later when she didn't get her own request to the state office in time to get on the ballot for the US House of Representatives. "I just don't understand all these election laws."

Does anyone know about the biggest anamoly of the Florida election of 2000? Valousia county had more votes casts for the US Socialist Candidate than the the entire country. (hmmm)

Does anyone know that the law regarding counting the votes on the "intent of the voter" was written and passed by a Republican legislature a few years before due to an election fiasco in Duval county? A great quote came from a woman in Duval county at year later. "How can we spend hundreds of millions of dollars rebuilding a football field, and not a few million to fix the voting system?"

BUT! If Al Gore would have won any other state, he would have won the election. He didn't even carry his own state of Tennessee.

2004. The democratic party picked George Bush's fraternity brother to run against him.

2007. The Republican legistature decides to move the primary election day ahead, and then Howard Dean screams "You broke the rules" and decides not to count Florida's Democratic Primary votes. A Florida Repbulican has gone so far to say that if the Democrats wont count Florida's votes, then we shouldn't have the Democratic Parties nominee on the ballot in 2008.

If the USA has issues with counting the votes of the State of Florida, then maybe the State of Florida should succeed from the Union.

I really can't wait for this movie, oddly enough. Who would think any of us would want to relive that horror so soon, but of course . . . it often seems too much like we already are.

50states, there are principles, rules and regualtions in politics. It is Hill the Bosnian General who has excluded MI and FL when she was convinced that she was the winner, but when she found herself in this situation where she is the loser, she is crying and misusing voters in FL and MI. God bless America and God bless Obama. OBAMA08.

Your comments support not just Christopher's take on his portrayal, but also Bill Daley's, Jim Baker's, and Jimmy Carter's (for some reason, Ron Klain doesn't seem to be on board). The reason for the departure from the truth seems pretty clear. Danny Strong had a dramatic arc he wanted to follow that depended upon showing Christopher as a wimp.needed to depended on a characterizing Christopher as a wuss. In order to maintain that theme, he steered a wide berth of Christopher, giving him none of the access accorded Klain, Baker and apparently a number of others. He waited even to talk to Christopher until the day that shot the scenes involving his character. "Dramatic license" is one thing---intentional distortion is another.

I laughed about Obama using Mondale's people to select a VP on another thread; it's so ludicrous.

But seriously, Obama doing this is a grave tactical error on his part. Remember those blue collar, middle class, hard working Democrats? They remember 2000 and how Bush set up his circle of advisors in the Governor's mansion and starting acting like he was the presumed winner. But that was AFTER the general election, not after the primaries when the voters could kick his *** back to Texas. Illinois - get ready to welcome back Barack Obama!

"Except the secretary of State's for both Michigan and Florida have certified the results for a Clinton win, not Obama.

GW Bush won because the Supreme court sided with the Secretary of State for Florida under state's rights.

By disenfranchising Florida and Michigan or worse still arbitrarily allocating delegates in direct opposition to the Secretaries of State, the DNC would be violating the US constitution and state's rights."

DNC has lost its mind. Pelosi, Dean with Kennedy and Kerry have gone INSANE!! DNC should replace them ASAP.

Do the democrats really think they can run against state's rights in Nov?

Just another nail in the Dem hopes for the white house if these two elections are overturned or ignored.

Spock,

We now know you are a GOP operative. Since you are posting a logical fallacy called post hoc ergo propter hoc which means "After this therefore because of this."

Since we are going to play your diminshed thinking skills game then gas prices have tripled since George Bush has been in office. So see it is still right Wing hacks that are responsible. Boy even Hillary Clinton undeducted White supporters know that putting two texas oilmen into the executive branch has been what caused the 4$ gas. Yee Haw. Spock.

No Whiners - Always a lib lets see the libs took over Congress fuel costs go up, food costs go up, but blame it on the GOP when they have nothing to do with it!!

The libs are the ones that will not lets us drill, build refineries, windmills, nuclear plants, but blame the GOP

And is it not the Libs that want to tax another 50 cents on a gallon of gas!!

The Feds make 18.5 cents per gallon of gas States make between 20 to 45 cents a gallon and the oil companies that most people own a share of makes only 8 cents a gallon.

Yes Blame the GOP even though the Libs control Congress, that is how blind you libs are!!

Also No Whiners it is the libs that live in basement being brainwashed by George Soros and company (MSM)

Saira B - talking about spinning!!
In his book he talks about turning America to Islam!! about how bad the White man is!! Yes he wants America to succeed but in his picture of Islam!!

Policy-wise, the differences between Obama and Clinton are actually quite negligible. The people who insist that "Hillary will fail America!" or "Obama is a racist!" clearly have not studied either of these candidates closely. If you read Obama's autobiography, The Audacity of Hope (ebooks and audiobooks version) you would know that no matter how much he wants to succeed personally, the success of America is much more important to him. America is doomed if John McCain wins.

Anne-
Get some education. Obama had offered to seat the delegates of both states. It's HRC that is turning it down. She wants it all her way. It needs to be fair. Both canidates signed agreements not to seat the delegates and now that it isn't working in her directions HRC is crying foul. I'm sure she wouldn't care about it if she were in the lead. Obama has been more then giving. Too bad she can't do the same.

i've listened to a couple of interviews of people who were actually there and this movie is total fiction. why waste your time.

Posted by: ron | May 22, 2008 3:46:45 PM

Anne,
Your candidate deserves to be slapped in the face. The rest of the party should stop dancing to her tune and end this race. She has lost ... GET OVER IT !!! If you want to vote for someone else go right ahead ... it is your right and I served to see that you have it. HRC's behavior is anything but democratic and she should not represent this party.

Definition of a Democracy -- a system of government by which political sovereignty is retained by the people. No longer true in America. OBAMA is selecting his VP and moving forward as the nominee without the needed delegates. He is telling the other candidate to go fly a kite. The “popular votes” is in question but he does not care. He is not going to win over the white collar population, and he doesn’t care, he says they will come around. Hold on to that thought, Mr. OBAMA, because it is not going to happen. Doesn’t he realize that he is slapping the face HALF of the American public that voted for the other candidate. There is NO WAY he is going to get all of their votes now either. The Party could have said to the public we have TWO popular candidates and ride it out…but by promoting the lesser, inexperienced black man because if you didn’t the party would be called racist shows a complete disregard for the American people. OBAMA is so wishy-washy in his talk---one day (May 18) Iran is just a “tiny” country and no threat to America, (May 19) Iran is a “grave” threat to America. Least Mr. OBAMA forgets a lot of good people have been trying to negotiate with terrorist ----Americans have been beheaded in the process.

Can barely wait to see the show, almost breathless

We will be watching intently to see if republicans are actually treated fairly

Posted by: Smith | May 22, 2008 3:33:34 PM

Congratulations on your involvement with the movie, Jake.

I predict mostly Democrats will watch it. They are the ones that still feel the need to examine what happened, and to try to find explanations and closure.

What is that saying? The winners write history and the losers write poetry.

Posted by: MayBee | May 22, 2008 3:11:31 PM

Obama is now in the process of selecting his VP - which means he is telling Clinton to take a hike, he is telling the readers of poll that he cannot win in the white collar states to go to hell, he is telling everyone he does not need to explain anything about his past, he does not need to bring the whites and blacks together, in fact he believes the teachings of his church that the whites have been the task masters too long, he is conceded and self-centered and by the way "lay off his wife". Although she will be the first lady ---you "America" as "I will not tolerate it". And, you've got it all wrong Iran is "a tiny country and not a threat to America" (May 18, 2008) which is to say Iran is a "grave" threat and I've said this all along (May 19, 2000). I will be your commander in chief but you will not know where I stand from one moment to the next because you will no longer be living under a democracy...I am in charge now!

Posted by: Anne | May 22, 2008 3:00:12 PM

I am glad this is almost over so some of America might walk away without hating the Clintons... did you hear what harold Ickes said today about only counting the delegates for Clinton in Michigan...you know where it wasn't supposed to count.

Get these people out of this country.

I am not positive Clinton won't rewin her seat in the Senate. Too many slimey political maneuvers.

America and New York are done with the carpetbagger.
