Where Has Obama Been on the Unconstitutional DC Handgun Ban?

I call it unconstitutional, because the U.S. Supreme Court just did, and they decide.
"Today’s decision is a landmark victory for Second Amendment freedom in the United States," said Sen. John McCain, R-Ariz. "For this first time in the history of our Republic, the U.S. Supreme Court affirmed that the Second Amendment right to keep and bear arms was and is an individual right as intended by our Founding Fathers...Unlike Senator Obama, who refused to join me in signing a bipartisan amicus brief, I was pleased to express my support and call for the ruling issued today."
Where is Sen. Barack Obama, D-Illinois, on this issue?
Tough to tell.
He was asked about it yesterday.
"Why don't I wait until the decision comes out, and I'll comment on it, instead of trying to prognosticate on what the Supreme Court is going to decide tomorrow," he said. "What I've said is that I'm a strong supporter of the Second Amendment. But I do not think that that precludes local governments being able to provide some common sense gun laws that keep guns out of the hands of gang bangers or children, that local jurisdictions are going to have different sets of problems, and that this is a very fact intensive decision that has to be made. But I do think that the Second Amendment is an individual right. So what I'd like to do is wait and see how the Supreme Court comes down and evaluate the actual reasoning in the case, to see how broad or narrow the decision's going to be."
But last year his campaign told the Chicago Tribune that Obama "believes that we can recognize and respect the rights of law-abiding gun owners and the right of local communities to enact common sense laws to combat violence and save lives. Obama believes the D.C. handgun law is constitutional.'"
But Obama campaign spox Bill Burton told ABC News' Teddy Davis that that statement "was obviously an inartful attempt to explain the Senator's consistent position."
What is that consistent position? At the Philadelphia debate, ABC News' Charlie Gibson asked Obama whether the ban was constitutional.
"Well, Charlie, I confess I obviously haven't listened to the briefs and looked at all the evidence," he said.
Earlier, during the Potomac primaries, Obama had the following exchange during an interview with WJLA-TV's Leon Harris:
HARRIS: One other issue that's of great importance here in the district as well is gun control. You said in Idaho recently - I'm quoting here - 'I have no intention of taking away folks' guns.' But you support the D.C. handgun ban and you've said that it's constitutional. How can you reconcile those two different positions
OBAMA: Because I think we have two conflicting traditions in this country. I think it’s important for us to recognize that we’ve got a tradition of handgun ownership and gun ownership generally. And a lot of people – law-abiding citizens use if for hunting, for sportsmanship, and for protecting their families. We also have a violence on the streets that is the result of illegal handgun usage. And so I think there is nothing wrong with a community saying we are going to take those illegal handguns off the streets, we are going to trace more effectively, how these guns are ending up on the streets, to unscrupulous gun dealers, who often times are selling to straw purchasers. And cracking down on the various loopholes that exist in terms of background checks for children, the mentally ill. Those are all approaches that I think the average gun owner would actually support. The problem is, that we’ve got a position, often times by the NRA that says any regulation whatsoever is the camel’s nose under the tent. And that, I think, is not where the American people are at. We can have reasonable, thoughtful gun control measure that I think respect the Second Amendment and people’s traditions.

The problem with that answer is that the DC handgun ban was not a regulation or a restriction of guns -- it was a ban.
As Justice Antonin Scalia wrote in the court's 5-4 decision today "the Second Amendment right is not unlimited. It is not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose: For example, concealed weapons prohibitions have been upheld under the Amendment or state analogues. The Court’s opinion should not be taken to cast doubt on longstanding prohibitions on the possession of firearms by felons and the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings, or laws imposing conditions and qualifications on the commercial sale of arms."
But that said, Scalia wrote, "the District’s total ban on handgun possession in the home amounts to a prohibition on an entire class of 'arms' that Americans overwhelmingly choose for the lawful purpose of self-defense. Under any of the standards of scrutiny the Court has applied to enumerated constitutional rights, this prohibition—in the place where the importance of the lawful defense of self, family, and property is most acute—would fail constitutional muster."
Recall that the plaintiff in the suit was a special policeman who wanted to have a handgun in his home for self-defense and was denied the lawful ability to do so.

Someone tell Obama that the Constitution over takes any law!! A State or Federal can not make a law that is unconstitutional.
Now I do agree that one no felonies (but when you commit a felony to give up your citizenship)
Mentally unstable should not - safety of the majority over comes individual rights
Automatic weapons I am against, but a pistol or rifle is fine.
About time the Supreme court read the Constitution!!

The problem is in BO home city of Chicago where there has been a gun ban for years, the only people that have guns are cops and criminals. 30 Chicago public school children have been killed in the last year. Yeah, that gun ban really works.

Senator Obama reminds me of a large fish pulled out of the water everytime someone asked him an important questions. He simply flip-flops, flip-flops, flip-flops until he gets back to the water where he is comfortable with the other fishes of his species, corrupt politicians. Such a dud.

I just finished looking at the news on most of the major outlets, and I'm wondering, who else besides obama is running for president. They have covered everything he could possibly say and do except his response on the recent ruling of the 2nd amend. Does it take his team this long to make up want they want him to say.

Answer: "Hard to tell"
It one listens or reads Obama comments on an issue today and juxtaposes his answer to one given one/two years ago, the answers are either contradictory or befuddled.
Obama is a lame excuse for a candidate and his followers are scary. How could the DNC do this to us.

OBAMA has it right. the constitution says we have a right to bear arms GOOD. in some cities crime is rampant with illegal weapons. Obama is mindful of ways to put that in check. It's easy to have a one sentence answer. When your loved one becomes a victim of an illegal handgun then you'll cry.

Bhrandon,I cant help but agree with you on this. But on careful observation I have come to understand why. Most news stations are owned by Republicans.So expect views to be tilted always. When Obama, came out, he was probably underestimated, all the news stations were mostly pro-Obama because they thought he will be easier to beat and that was to the detriment of Senator Clinton. Towards the end, the media now became hell-bent on destroying Obama. From bittergate, to Wrightgate, to Lapelgate etc but by then it was too late but its still not too late on the Presidential elections and thats why Obama has to double his efforts. Mccain is a brand-name and will never be easy to beat. Forget the polls. Obama has to continue to develop his own name and he is really making a good effort. Forget the people accusing him of being arrogant, people that have met him in person know otherwise. His slogan says it all, 'Yes we can'.

The ruled that it's a right, and that they have the right to restrict it. The right to keep and bear arms in an unalienable right granted by the Constitution. This ruling is a huge step in the aims to confuscate arms and restrict gun owners by refusing to give permits for their guns. (Therfor the right to confuscate and deny the right to purchase arms) It's a horrible decision. No wonder the liberal gun grabber McCain was so much for it.

I believe the Supreme Court ruled correctly in upholding the Second Amendment over the D.C. handgun ban.
I hope that with his Harvard law degree background, Sen. Obama will agree that the Supreme Court was right in their defense of the Second Amendment.

obama is trying to hem-haw around yet another issue and try to have it both ways. He's a "people-pleaser", and will say just what people want to hear for the moment. He's too flip-floppy to have a REAL stance on this issue.

Obama parallels honest, hard working citizens with the criminal underclass–that he draws no distinction. In Illinois, I have seen Obama vote in ways that suggests that he values the lives of the criminals over the lives of citizens. Or, perhaps, he thinks that the government should be the sole repository of real power in this country, and citizens killed by criminals are just “acceptable collateral damage” in the cause of advancing the primacy of the government.

We know how the illegal guns are ending up on the streets. Its because of all the free handouts and welfare that Democrats have created. Democrats cannot create jobs by taxing businesses out of the country.

Obama has the views of most moderates. Thats why he may seem closer to the left and yet closer to the right on gun control. No one condones violence and at the same time most people think it will be unconstitutional to ban guns. The problem is how to balance those views. Forget what Mccain is saying on gun control. He is just reversing himself. No one is calling him on all his flip-flops. Check his ratings with the NRA. How do we balance this? Balancing this is going to be difficult because there is no way of controlling gun without impinging on gun owners rights. Obama knows this and thats why as a constitutional lawyer, he realises the importance of the second ammendment and the right to bear arms and at the same time will like laws enacted to prevent it getting into the wrong hands.

Here is an ugly list that most liberals love about Obama
He voted against requiring medical care for aborted fetuses who survive
He supported allowing retired police officers to carry concealed weapons, but opposed allowing people to use handguns to defend against intruders in their homes.
I could go on with all this creey stuff about Obama but librals already know and love him
Obama was being misleading when he denied that his handwriting had been on a document endorsing a state ban on the sale and possession of handguns in Illinois. Obama responded, "No, my writing wasn't on that particular questionnaire. As I said, I have never favored an all-out ban on handguns."
Obama flat out lied during a Liberal Debate about his signature being on that form and no one challenged him on it.
Obama has to lose.
