Obama Campaign Tells TV Stations Not to Run NRA TV Ads

September 26, 2008 12:37 PM

In this letter sent this week to TV station managers from Obama campaign general counsel Bob Bauer, obtained by ABC News, the Obama campaign argues that a TV ad by the National Rifle Association should not air.

"Unlike federal candidates, independent political organizations do not have a 'right to command the use of broadcast facilities,'" Bauer writes. "Moreover, you have a duty 'to protect the public from false, misleading or deceptive advertising.'"

The Obama campaign takes issue with an ad called "Hunter," pointing out that claims in the ad were called "false" by Factcheck.org, and was given three Pinocchios by the Washington Post's "Factchecker."

"This advertising is false, misleading, and deceptive," writes Bauer. "We request that you immediately cease airing this advertising."

In response, Cleta Mitchell, Counsel to the NRA, fired back in a letter to station managers that the fact checkers in this case are wrong.

"We respectfully request that your station disregard the shamefully false assertions from the Obama campaign and its attorneys," Mitchell writes. You can read more of Mitchell's letter at the blog of Ben Smith of Politico, who reprinted it in full.

isn't it interesting how gun control is the answer. just like in Chicago where handgun bans are some of the most stringent in country. a little research shows between Labor day & Memorial day of this year 123 people died due to guns in that city. i'm sure the victums appreciate their governments concern for their safety

Posted by: singray | Oct 4, 2008 9:57:46 AM

just remember you lefties your speech can be silenced too. once Obama opens pandora's box it will effect everyone. one thing is for sure. show us conservatives how to use legal means to shut you up and i will be more than willing to use the same tactics Obama employs against you. the law once precedent is set can be used against you too.

Posted by: singray | Oct 4, 2008 9:53:04 AM

I have been a loyal member of the NRA for years. If there was a gun ban, would the criminals and the gangs give up their guns? Of course they wouldn't? In the large cities the gangs would take over and and the law biding citizens who gave up their guns could not defend themselves. I cannot believe anything that Obama says or does. I do not trust him.

Can McCain sue for the all the false ads from the Obama campaign and 527s that support him? If not, then he should stop whining about his hurt feelings and try actually leading for a change.

freedom of speech is not a lisence to lie and libel. He is a constitutional scholar and he is acting responsibly, unlike the GOP/NRA.

(I think you mean license)

Obamma is not a constitutional scholar. He is a "politician" who belives that he can make anything written into what he wants it to say.
His comments on the meaning of the second amendment are proof positive of his total ignorance of the meaning and motive of the constitution. A quick reading of the Madison Papers would have told him everything he did not want to know. Are you really that gullible ?? This is about the same kind of dirty politics he used to get elected in Chicago. Don't run against those who oppose you, get them off of the ticket. Obamma is a liar, and only those who would vote for a yellow dog if it was a democratic would believe anything he says. Bobble Heads for Obbbbbbammmma

Ah, sure, she is an "independent voter"
just like obamma has told the truth about his stand on guns.

It is this kind of democratic duplicity wwhich is especially galling.
I won't even try to confuse you with facts, as the democratic party has made up your mind for you.

Posted by: michael archangel | Oct 2, 2008 4:35:07 PM

The NRA has proven that the ads are factual. Factcheck is an organization that is supported by the same folks that support brady bill backers. Obama's voting record(the times he didn't vote "Present") in IL is totally anti gun even though he says he supports gun owners rights.

"Has the McCain campaign attempted to take down Obama ads through legal intimidation? No."

Neither has the Obama campaign attempted to take down McCain ads through legal intimidation.

Obviously, Obama and his people believe the NRA is a much greater threat to the campaign than McCain is.

Posted by: Michael Ejercito | Sep 30, 2008 2:40:23 PM

If factcheck.org is non-partisan why is it fully funded by the Annennberg Foundation which also funded Williams Ayers and Obama's Annennberg challenge?
They are.

They've debunked the Obama campaign's claims in the past.

It surprised many of us that they were sloppy in their attempted refutation of the NRA ads.

Posted by: Michael Ejercito | Sep 30, 2008 2:38:48 PM

"you have a duty 'to protect the public from false, misleading or deceptive advertising.'"
So TV stations should not run 95% of political ads?

The same FactCheck.Org which countered the NRA ads (though not accurately), also debunked claims in Obama campaign ads.

Posted by: Michael Ejercito | Sep 30, 2008 2:37:03 PM

I read the NRA'S rebuttal to the FactCheck.org piece.

It is amazing that they were so sloppy, especially as they are not in the tank for Obama and have in the past debunked claims in Obama campaign ads.

Posted by: Michael Ejercito | Sep 30, 2008 2:35:28 PM

Obama is an attorney so it shoulodn't surprise anyone that his campaign will try to use legal means to stop certain things from getting aired. I have seen his voting record on the Second Amendment and it's scary. I understand that people are concerned about gun violence and I understand people want senisble legistation; however, the 40,000 plus gun related laws in the US aren't enforced as they should be. Now this abuse of the First Amendment is even more alarming. Frankly, I would vote for Obama if he wasn't sooooo anti-Constitutional. At these sen. McCain nows what it is like to defend the US Constitution instead of shredding it. As far as that post goes about the oil and gas prices, come on people!!! Last time I checked the DEMS were in charge of Congress and the gas prices went up not down. The President only has limited powers. Congress runs the show. Also, regardless of your party, both sides are getting rich off the oil. Obama had gotten money form oil companies as well. And as far as this economic crisis!!! I was at the mall yesterday and everyone was eating out and shopping at some pretty expensive stores. SO is the economy that bad??? Also, I lost my house after I left the military as an Officer b/c my pay got cut in half; I tried everything to save my house but the bank would not budge. I even used all of my savings; my load was a traditional 30 yr fixed. They point here is that I don't blame the government for me foreclosure. Please wake up and don;t listen to the media but rather investigate several sources of info. and don't vote by party but by issues.

Respectfully,

What happened to the First Amendment right to free speech? Is this not a violation of the civil rights of those in the NRA? Present the other side too and let adults decide what they believe.
the government is not to be our parent.

This is the second legal action against a radio station in Chicago and NRA here. Signs are banned at rallies. A group of attorneys calling themselves the "Truth Squad" have been set up in
MO to legally act about any ad they think is wrong. This is the Obama campaign, folks acting like police.

I can never remember any candidate ever taking so many legal actions against opponents. Hillary had this issue with Obama also.

If factcheck.org is non-partisan why is it fully funded by the Annennberg Foundation which also funded Williams Ayers and Obama's Annennberg challenge? Why are the bios of all staff and researchers very liberal in training and work experience. It is asking a foundation associated closely with Obama to decide if his opposition is correct---reasoning minds would neither trust nor accept that as the best source of checking facts.

Posted by: von | Sep 29, 2008 1:46:28 AM

Where is the outrage? Are we even capable of it anymore? This ought to scare the hell out of anybody who gives a damn about the 1st Amendment. Instead, it looks like America is perfectly happy to elect this guy. America gets the government and the leaders that it deserves.

Posted by: A. Bitter Clinger | Sep 29, 2008 1:30:19 AM

Before anyone makes another "fire in the theatre comment," I think it must be pointed out the NRA is buying time. The Obama campaign is threatening and intimidating stations which carry the NRA's purchased message.

This is an attempt to be pre-emptive by the Obama campaign. Were it governmental, it would be censorship.

What part of "freedom of the press" do you liberals not understand?

I live in a China. If you want to see how the media will work under an Obama administration, you're welcome to move to Beijing.

Whether McCain has a high chance of dying of Melanoma is relevant to choosing a President.

Posted by: josh | Sep 28, 2008 11:27:51 PM

The document that the lawyer wrote seems to prove that there is no proof that the Ads were incorrect. Also, I've seen Obama's voting record. He has voted in support of infringing on gun ownership repeatedly. Didn't he ban handguns in Chicago? Is it safer now? Screw that, I'm joining the NRA. Anyone got their phone number?

Posted by: Captain America | Sep 27, 2008 1:43:29 PM

DOES THIS BOTHER ANY OF YOU OBAMA SUPPORTERS?

Posted by: Rianna | Sep 27, 2008 12:24:55 PM

Notice a pattern here? There is an Obama-sponsored "Truth Squad" in Missouri to combat any "perceived" lies about Obama on the airwaves; Sen. Barack Obama has warned TV stations and asking the Justice Department to intervene in an attempt to block the airing of an ad by a non-profit group that links him to an unrepentant domestic terrorist; now this latest ABC News Obama-censorship story. Meanwhile, The New York Times ran a story yesterday stating that FIVE of Obama's anti-McCain adds (including the stem-cell ad) contain FALSE information and LIES about McCain. Obama is NOT playing fair, but playing his friendly mainstream media. This suppression of free speech by Obama & friends should warn all of you of what is to come if he wins. SCARY!

If ABC had the guts to air some more of the REAL truth about 'O', and his shady background, they would gain so much market-share, their invertors would be proud. (see FoxNews)

You people that blame our gas prices on Bush need to get your facts straight. It was people like Obama that banned offshore drilling which would have made our gas prices lower. our economy right now is crap because of the gas prices, its a vicious cycle that we are stuck in because we cant drill for oil. people are losing their houses because it costs them hundreds of dollars a week to drive to work. Vote for a president who wants to keep this us NOWAY! Mcain/palin 08

This is to Jessica I would rather have a Bush the third then a Jimmy Carter the second. I don't believe you understand the dangerous policies Obama believes, or that he is exactly like Carter. I already pay my share in taxes I don't wish to pay more. Also, I am from Illinois so I know exactly who Barack is a man who would rather send a man to prison for shooting someone in self-defense, because a gun ban exsists, then make gang members eligible for the death penalty in a drive by shooting. Grow up.

Posted by: Candy | Sep 27, 2008 6:30:53 AM

I am an independent voter and my vote could go either way. But you can't persuade me to vote for Bush Jr...McCain! If anyone need to wake up it's the people who do not realize what a steak and stake president Bush has had in oil, and just how John McCain plans personally to follow him into financial bliss! He got his wife Cindy and all her beer baroness inherited money, now John's after the big gun! And that's oil! John McCain will even appease his potential voters "to get them off track" so that he can get in office and get his hands on the biggest asset right now and that's oil~!
An oil slick is coming... and you will not be able to hold on, because this deal is a personal deal made by Bush and subscribed to by John McCain. John wants his turn at oil investing internationally (who cares the cost at home) so long as John and his financial buddies get a piece of the national pie!
If your voting for John McCain, I hope you get some "interest" for the pain!

Jake, I have a question for you. Aren't you (or ABC) a little concerned about freedom of speech issues with Obama at the helm? Okay, sure you guys on the right side of the issues now but what if he and/or the Democrats do something that the news business feels it should report even though it isn't flattering to the Democrats? Is the 'Truth Squad' going to hit you guys too?

Posted by: WylieD | Sep 26, 2008 3:30:08 PM

Actually, the McCain campaign has run ads based on Factcheck - misleading ads, sure - but they used Factcheck as their basis. Now Factcheck is wrong?

Posted by: mara | Sep 26, 2008 3:28:28 PM

Last I checked, the 1st Amendment didn't have a clause that allowed restrictions on free speech if David Axelrod thought it unfair to his candidate.

In fact, Obama is on record supporting Chicago's ban on handguns. And there is that inconvenient questionnaire his campaign submitted then denied. The worker who filled out the questionnaire is on record as stating that it accurately reflected Obama's views.

Posted by: WylieD | Sep 26, 2008 3:27:47 PM

I am truly concerned for the future of our country if this man is elected. He has already used legal means several times in order to get what he wants - with FL and MI re-voting in the primaries; blocking the Ayers ad through these same legal maneuverings; his infamous clearing of the field with his opponents in Chicago.

He's sly as h*ll and I don't trust him one bit. Any other politician with his radical associations would have been taken out of the race by now. Please research for yourself ACORN and then realize that not only is that the group Obama did his community organizing through, but he was also their attorney through years of charges of voter fraud.

Wake up America! A revolution is happening and 3/4 of the voters are sleeping through it!

Posted by: marylou | Sep 26, 2008 3:22:04 PM

Team Obama is starting to freak me out. On Drudge there is a link to a news station in MO that reports that Obama now has prosecutors and sheriffs involved in making sure false or misleading ads are not put on TV. They say nothing about false or misleading ads put out by their own campaign ... only their competitor. By whose standards are they going to consider an ad false or misleading?

"And the left has the unmitigated gall to call Conservatives fascist?"

It could be worse. The right could be calling Obama a Harvard lawyer.

Posted by: len | Sep 26, 2008 3:17:09 PM

Seems the NRA is going off of Obama 's actual record and factcheck is only going off of what he has said. Barry is the guy who thought the DC gun ban was constitutional, until it was ruled unconstitutional then he changed his mind. Barry has also supported bills that would make it a felony if the gun you owned was stolen and used in a crime if it was not "secured" on your property. Obama also filled out a questionnaire saying he wanted all handguns banned, he denies this despite his handwriting being on the questionnaire. he also wanted to ban ALL semi automatic firearms and make it so you could not claim self defense if you used a gun in your home.

McCain Wins Debate

Although the fate of tonight's presidential debate in Mississippi remains very much up in the air, John McCain has apparently already won it -- if you believe an Internet ad an astute reader spotted next to this piece in the online edition of the Wall Street Journal this morning.

"McCain Wins Debate!" declares the ad which features a headshot of a smiling McCain with an American flag background. Another ad spotted by our eagle-eyed observer featured a quote from McCain campaign manager Rick Davis declaring: "McCain won the debate-- hands down."

Here's the screenshot.

How anybody in their right mind can vote for McCain needs to get what they deserve, 4 more years of lies, cheating and deception, just like McCain's ragged performance of 'suspending' his campaign. Give me a break, first of all his campaign was never suspended, his campaign people were still working around the clock, secondly, they never needed him in Washington, especially since he never even was in communication with anyone during the entire bailout fallout, and third, he only went for a photo op which kicked him in the butt because he sat there and said nothing and everyone said he didn't need to be there, they had already come to agreement. And after telling George Bush to contact Obama to get there too, what drama. He just looked so stupid, he was doing absolutely NOTHING for country, he was and still is doing EVERYTHING for McCain, and his campaign! Go Obama/Biden '08!!!!

He was bad at Saddleback because BO was tired from his vacation--and McCain cheated.

He looked horrible at the debate with Hillary because George and Charlie picked on him.

If he loses the election it is not because of his many flaws, or because McCain has more experience and better judgement--but because voters are uneducated, or racist.

Obama campaign is making a very weak argument by using FactCheck as a citation. FactCheck is written by journalist. Now-a-days with biased media we cannot trust that information.

So, Obama should come up with better reason to stop airing the ad.

The McCain campaign should counter this and request that the dispicable ad that Howard Dean's brother produced, which shows close-ups of McCains face following his cancer surgery, and suggests that McCain is quietly slipping away from melanoma also be removed from the air.

The ONLY network that has agreed to run the ad thus far is MSNBC, which should tell you something.

This ad sets a new low standard for political advertising, and it only figures that Dean's brother would be a party to it.

To freedomfighter1975 and Chris,

First amendment rights come into play with political adverstising. Who can say what based on funding is not a simple issue. What is clear, however, is the 527 groups are free to express their opinions on the airwaves. We're not quite Venezuala. Yet. If any candidate thinks the content rises to the level of slander they can simply sue the producer and/or broadcaster.

Of course with slander cases you must have only one thing on your side, the truth. Notice Obama doesn't contest the specifics of the content, he merely tries to intimidate station owners.

As far as "three pinnochios" goes, oooooo, scary. Factcheck.org, would that be funded by the Annenberg Foundation? Probably unimportant.

Before any simple minds on here start the weak argument that this is an assault on the 1st amendment you would be wise to understand it better. The first amendment does not give you the right to say whatever you want. It is the same as yelling "fire" in a crowded theater.

I am not casting my vote on whether McCain or Obama are for or against the NRA... at this point there are more important thing on my table. Like my job and paycheck.

"you have a duty 'to protect the public from false, misleading or deceptive advertising.'"
