Customs Officials Refer Leak of Obama's Aunt's Immigration Status to Inspector General

Officials at the Immigration and Customs Enforcement department have referred the disclosure to the media of the immigration status of Sen. Barack Obama's Aunt Zeituni Onyango to the Department of Homeland Security Inspector General and the office of professional responsibility.
The disclosure may have been a violation of federal privacy laws.
ICE spokeswoman Kelly Nantel in a statement said, "Yesterday morning, ICE referred the matter to the Inspector General and our Office of professional Responsibility for review. They are looking into whether there was a violation of policy in publicly disclosing individual case information."
Late Friday night, The Associated Press reported that Onyango -- whom this week the Times of London and the Boston Globe found living in a Boston housing project -- is in the United States illegally.
A person familiar with Onyango's immigration status told the AP Friday that she "was instructed to leave the United States by a U.S. immigration judge who denied her asylum request... Onyango's refusal to leave the country would represent an administrative, non-criminal violation of U.S. immigration law, meaning such cases are handled outside the criminal court system. Estimates vary, but many experts believe there are more than 10 million such immigrants in the United States.
"Information about the deportation case was disclosed and confirmed by two separate sources, one of them a federal law enforcement official," the AP reported. "The information they made available is known to officials in the federal government, but the AP could not establish whether anyone at a political level in the Bush administration or in the McCain campaign had been involved in its release."

Why is ICE concerned about protecting the privacy of this non-citizen who has overstayed her visa but not bothered by the fact that she and millions like her are living off American taxpayers? Our economy is collapsing under the weight of entitlements for these people, and ICE is worried about privacy? If they can find her to interview her, why can't they put her on a plane back to Kenya?

How many of McCain's relatives are on welfare, have legal or illegal employment etc. If Obama should be judged by someone he hardly knows but is related to McCain should be subject to the same thing. I say bring out all the family members of slaves his family owned, and kin who immigrated to the U.S. Then we can talked about Cindy McCain's half sister and the like.

The reporter incorrectly stated that the aunt's failure to depart the United States was a civil, not a criminal violation. In fact, it is a criminal (felony) violation under Title 8 USC 1253.
Sec. 1253. Penalties related to removal
(a) Penalty for failure to depart (1) In general
Any alien against whom a final order of removal is outstanding by reason of being a member of any of the classes described in section 1227(a) of this title, who -
(A) willfully fails or refuses to depart from the United States within a period of 90 days from the date of the final order of removal under administrative processes, or if judicial review is had, then from the date of the final order of the court,
(B) willfully fails or refuses to make timely application in good faith for travel or other documents necessary to the alien's departure, (C) connives or conspires, or takes any other action, designed to prevent or hamper or with the purpose of preventing or hampering the alien's departure pursuant to such, or (D) willfully fails or refuses to present himself or herself for removal at the time and place required by the Attorney General pursuant to such order, shall be fined under title 18, or imprisoned not more than four years (or 10 years if the alien is a member of any of the classes described in paragraph (1)(E), (2), (3), or (4) of section 1227(a) of this title), or both. (2) Exception It is not a violation of paragraph (1) to take any proper steps for the purpose of securing cancellation of or exemption from such order of removal or for the purpose of securing the alien's release from incarceration or custody. (3) Suspension The court may for good cause suspend the sentence of an alien under this subsection and order the alien's release under such conditions as the court may prescribe. In determining whether good cause has been shown to justify releasing the alien, the court shall take into account such factors as - (A) the age, health, and period of detention of the alien; (B) the effect of the alien's release upon the national security and public peace or safety; (C) the likelihood of the alien's resuming or following a course of conduct which made or would make the alien deportable; (D) the character of the efforts made by such alien himself and by representatives of the country or countries to which the alien's removal is directed to expedite the alien's departure from the United States; (E) the reason for the inability of the Government of the United States to secure passports, other travel documents, or removal facilities from the country or countries to which the alien has been ordered removed; and (F) the eligibility of the alien for discretionary relief under the immigration laws.

We do not yet know the facts about Obama and his aunt's relationship.
We do know that the revelation of Obama's aunt started with the Times of London, which is owned by the owner of Fox News.
Fox News was the first US news source to publish information and have a TV report about Obama's aunt on Friday.

ICE released private information about Obama's aunt.
Another strange thing is the McCain campaign saying it was a family issue and they had no comment. McCain has not had any problem lying about Obama for months. Why didn't they jump on the aunt issue?

Why has Obama gotten a pass at EVERY TURN OF EVENTS? Could you ever imagine any candidate being propelled by the liberal media like this? No white guy, that's for sure. No white guy could have ties to terriorists, racists or criminals (or ACORN) the way Obama has.
And as for his exotic family ties and questions surrounding his life - as Ferraro said "he's lucky he's black".
Wake up America.....we're being bamboozled and hoodwinked. Why the double standard with our political candidates? Sorry.....I'm not buying this excuse for a Presidental candidate and my COUNTRY COMES BEFORE PARTY. Dems shouldn't want a win this bad.

Why is this even a problem for Obama? He's a US Senator, he could have sponsored her for citizenship at any time, and she would have sailed through. Instead, she has a deportation order. Barry, if you can't help your family, how are you going to help me?

Incredible... my contribution to this blog just got censored! Let me try again.
This whole affair is just too strange.
1) Knowing how people will do anything to stay in the States, I simply do not believe that Obama's aunt did not have contact with her nephew. Trust me... even distant family will find you, if there's a chance you can help their case. And we’re talking about a friggin U.S. Senator!
2) What kind of doublespeak is the statement: "Senator Obama has no knowledge of her status...". What does that statement even mean? It doesn’t say that Senator Obama did not know that she was in the States. It does not say that he was unaware of her living in public housing in deplorable conditions. It doesn’t say that he did not know that her application for refugee status was denied. It simply says that he doesn’t know what her status is AT THIS MOMENT! (Gee, I forgot how much I missed Clintonesque semantics!)
3) By the way, if Obama did not have contact with his aunt, it’s only because he NEEDED not to have contact with his aunt. For God’s sake, she’s listed in the White Pages (online): Zeituni Onyango / XXX Bowen St / XXXXXX, MA XXXXX-XXXX / (XXX) XXX-XXXX. (I hope that the XXX addresses the concerns of the ABC censor)
4) Noting how easy it was for me to find the listing, explain to me how the media, so determined to leave no stone unturned in its “journalistic service” to the public, never even bothered to look. How embarrassing for the US press to be outsleuthed by the Times of London. “White Pages… online”… my, how clever!
5) Senator Obama is poised to be elected President of the United States… so let’s not spoil the historic moment by actually expecting truthful answers to real questions.
6) Sure, now we’re concerned with a possible violation of an illegal alien’s right to privacy… and yet the press practically drooled watching Joe the Plumber get roto-rootered up his...
7) Auntie Zeituni will obviously not be going back to Kenya. The Obama campaign statement has already said that it “believes that any and ALL appropriate laws be followed”. More doublespeak, I assure you. I’m sure a President Obama will figure out something… Indeed, Aunt Zeituni has been counting on it all along!

Auntie has been here for 8 years and WAS AT OBAMA'S INAUGURAL SENATE win. He knows all about her being here; he wrote about her in "Dreams of My Father". I guess he doesn't mind breaking rules of all sorts.

Voter fraud has already happened in Ohio with irretreiveable votes in a box, about 200,000. If there is a way to cheat this thing Obama supporter will master it, like they did the caucus system against Hillary. Obama and ACORN ties give HIM the advantage, but Americans do the right thing in the end.
Like the four guys who took down Flight 93 on 9/11, on it's way to our Capitol. That's what we (McCain supporters) would do....and we are going to stop this disaster that would be an Obama Presidency.

I understand there should be a certain degree of the right to privacy afforded to U.S. citizens, but first of all this woman isn't a U.S. citizen. She is here ilegally.
Beyond this topic, we have never had a candidate for president with so many details about him and his past/family/friends so hidden and inaccesible. Yes, one deserves a right to privacy, but if you choose to put yourself in the position of running for the highest office in the land, you have to sacrifice some of that right. I thought that was pretty much understood. By hiding almost everything about his life that would be of importance or interest in evaluating Barack Obama's ability to be president, it sure tells me there are some pretty negative things he doesn't want us to know about. PLEASE PEOPLE, make sure you know who you're really voting for before you cast your ballot on Nov. 4th. This is one of the most important elections of our lifetime!

Only misplace values is with the GOP. Yelling about ACORN when they voter cage and fix machines. Reality check Voter Fraud can't happen before votes are cast, they happen in the voting booth. Mickey Mouse can get registered but he has to show up with a valid ID. But I guess reason and morality has left the building with the GOP.

Auntie should be deported, thats should be the priority. Otherwise we are giving special treatment to the Aunt of a member of congress.
The leak exposes this fraud. Going after the people who leaked on the grounds that it violates the illegral alien's privacy rights is total stupidity.
Correct the fraud.
