Holder v Bush on War on Terror Tactics

In June, former deputy attorney general Eric Holder gave a speech to the American Constitution Society (ACS) in which he blasted the Bush Administration's tactics in the war on terror, saying the nation needed to reverse “the disastrous course” set by the Bush administration.

"We have quite frankly lost our way," Holder said, calling for the U.S. to close the detention center at Guantanamo Bay ("an international embarrassment"); declare that it is the law, policy and practice that the U.S. does not torture people or subject them to cruel or inhumane treatment; end the practice of rendition; and stop any warrantless domestic surveillance.

“Our needlessly abusive and unlawful practices in the ‘War on Terror’ have diminished our standing in the world community and made us less, rather than more, safe,” Holder said. “For the sake of our safety and security, and because it is the right thing to do, the next president must move immediately to reclaim America’s standing in the world as a nation that cherishes and protects individual freedom and basic human rights.”

To the intimate recording question, yes there is always the temptation of "Gyges' ring" to pry for sheer prurient reasons because you are invisible.....My dad was a telephone installer and repairman for 40 years and you'd be surprised at what has always been able to happen to your personal communications but how quietly but harshly phone companies deal with such activities.

Also part of Alex Bell's original deal with government for monopoly was to be subject to government requests especially in time of war, and that legacy remains, some of it tradition, some contractually or by statute, such as FISA immunity.

Do you think Obama will undo the Patriot Act or defang a FISA revision that he just voted for that FINALLY was a permanent legal fix to meet the real demands of contemporary intelligence gathering?

NO, he and his Administration will and SHOULD use the tools available to it to defend this country.

How long will it take to close Gitmo, the prison that is (not the entire base which we will only renegotiate with Cuba when the Castros die and their regime fall). I'd say at least 2 years if ever to repatriate some (that is extradition to some harsh regimes - is that rendition to certain mistreatment??), try some (yes Khalid Sheik Mohammed will get his day in court not just Osama's chauffeur).

Will we release those who cannot be tried without revealing what we know about sources?

Yes its been such a disaster that we have not been attacked again since 9/11. But don't worry AG Holder will change that...

Why doesn't former deputy attorney general Eric Holder invite these poor deprived and tortured terrorist to stay at his house with his family. We would gladly pay him to put them up for us in his home. Since these guys are really nice guys, Eric Holder shouldn't mind assumming all responsibilities for the actions of his friends.

I might be the only person in this world who is in 7th heaven these days. I'm just happy with all the decisions these days. Rahm, Valerie, Holder even Hill and Joe L. Obama should really try to do something to disappoint me because I really was bracing myself for some let downs and so far he has disappointed.

As for Holder, wow Jake, thanks so much for that video. He should have been president! (and i'm the #1 Obama supporter). Now if only I could see his upper lip, i would have slept a happy person.

Get over it. We are data-mined from everyone from Amazon to Verizon for commercial reasons. In the pursuit of terrorists, wide nets must be cast before authorities can narrow to warrantable suspects.

So you want to tell American soldiers that called home to their wives from the battleground and had their most intimate and personal calls recorded and some saved for future enjoyment by the "surveillance" staff to "get over it"?

He who would not bring against a new prisoner such as Khalid Sheikh Mohammed the harshest of treatment to ascertain Al Queda's operational plans is not worthy to serve our country.

If a terrorist belongs to another country, how would we not return him to meet justice? Why would we thus interfere in the internal affairs of a friendly nation?
