Executive Order Being Prepped: PEBO to Close Gitmo

ABC News has learned that the Obama Transition Team is working on drafting an executive order for President-elect Obama to sign that would close down the Detention Camp at Guantanamo Bay.
The order could possibly be signed as soon as President-elect Obama's first day in office, Jan. 20, and is likely to be signed that first week after he's been sworn in.
The plans were first reported by the Associated Press.
During his presidential campaign, Mr. Obama called Gitmo a "sad chapter in American history" and pledged to shutter it as soon as he could.
On This Week, Mr. Obama told George Stephanopoulos that "I think it's going to take some time and our legal teams are working in consultation with our national security apparatus as we speak to help design exactly what we need to do."
Mr. Obama said the process of closing the camp "is more difficult than I think a lot of people realize. Part of the challenge that you have is that you have a bunch of folks that have been detained, many of whom may be very dangerous who have not been put on trial or have not gone through some adjudication. And some of the evidence against them may be tainted even though it's true. And so how to balance creating a process that adheres to rule of law, habeas corpus, basic principles of Anglo-American legal system, by doing it in a way that doesn't result in releasing people who are intent on blowing us up."
But Obama didn't mince words about the future of the camp.
"I don't want to be ambiguous about this," he said. "We are going to close Guantanamo and we are going to make sure that the procedures we set up are ones that abide by our Constitution. That is not only the right thing to do but it actually has to be part of our broader national security strategy because we will send a message to the world that we are serious about our values."

CAn I ask this. What are we planning to do with the prisoners whose countries don't even want them back? I am confused here. Hopefully not in my state or even near.

Yeah! Imagine how high our standing will be when we release known terrorists! Oh boy.
Wow! everyone is going to be so impressed when we give them back their weapons and drop them back off wherever they need to go. Or they could crash here for a while and get some wheatgrass smoothies.
Maybe some of them can go on the View or catch Spamalot so they can get a better opinion of our culture. That will be totally great! If we can get the Jonas Brothers to grow beards then everyone can let the healing begin!

If so many people in his own country disliked Bush so intensely, imagine how people in other countries felt.
In a few short days, the United States will be in better standing than it's been since Bush squandered and abused the good will people felt towards the States on 9/11. Such arrogance he put out.

Obama needs to go one step further. Close Guantanamo Naval Base entirely. This anachronism left over from the Spanish America War is a blotch on our foreign policy and our image throughout the world. To maintain a military base on sovereign foreign soil, in a country that obviously doesn't want us there, and in a location just 90 miles from our own land and therefore of no strategic value is ludicrous.
It is just a continual slap in the face to the Cuban people and their legitimate government (whether we like it or not), and all dates back to JFK and the fact that Castro kicked the mob out of Cuba when he took control. Get over it. Recognize Cuba, grant full relations, both trade and diplomatic with them, and get on with life. Not everybody wants to be our buddy or to adopt our government or our way of life. So what?

In Afganastan were we should be we're losing ground. He couldn't even get binladen who is laughing his @ss off at us. And he kept us safe? ight no one got killed in the US. but what about the 4000 Americans who were killed in Iraq. What about the 30,000 who are disabled, no legs, no arms, no brain. No, Bush screwed us. Not intentionally. It's just that he's an arrogant idiot. May be the worst pres ever. EVER!!!!

That's what we get for taking prisoners. You have to know in these politically correct times, the minute you put these terrorists in a detention camp the wheels start turning on how it's unconstitutional and they must be let go. Like the cop who arrests the same guy for the same thing 5 times in a year. Maybe we should just settle it on the battlefield. Take No Prisoners!!

Obviously civics is no longer being taught in school.
First, The US has the right under the constitution to prosecute anyone in the world for crimes against the United States.
Second, The world courts have all consistantly ruled that war crimes can be tried by the country against which the crimes were committed.
Furthermore the concept of Universal Jurisdiction states that war crimes in particular can be prosecuted by any nation state.
The International Criminal Court routinely handles war crimes for the world (some notable exceptions are Nuremburg, Rwanda and Yugoslavia which are seperate tribunals) The United States however is not a signatory to the ICC and therefore has not given up it's jurisdiction over War Crimes to the ICC.
George Bush established the Universal Jurisdiction over terrorists (and he literally unsigned us from the ICC treaty) which gives the US the right to prosecute Terrorists.
Gitmo was used because it kept them off American Soil. Once on American Soil, Terrorists would gain access to our Federal Court system, and would eb granted many more rights than those in a War Tribunal would.
PEBO closing Gitmo is an honorable thing (on the surface) but like most things promised by PEBO, it is not easily done, nor will it work how he wants.
The minute he agrees that Gitmo is a travesty of Justice (which is about what he said) as President, then those in Gitmo can appeal to the US courts that they were subjected to cruel and unusual punishment, and they may win freedom. It is a can of worms that PEBO might want to avoid.

Obama thinks we need to go back to when Clinton was in office - a "softer", "gentler" time when we allowed attacks on America - Trade Center 1, USS Cole, African Emabassy, and Trade Center 2 (terrorists were in this country and the CIA was gutted under Clinton's watch).
With Panetta in the CIA, Obama will again gut our intelligence agency - just like Clinton - and will not go after terrorists. He just wants to get re-elected. Deja Vu.
