White House Denies Charge By Attorney that Administration Threatened to Destroy Investment Firm's Reputation*

A leading bankruptcy attorney representing hedge funds and money managers told ABC News Saturday that Steve Rattner, the leader of the Obama administration's Auto Industry Task Force, threatened one of the firms, an investment bank, that if it continued to oppose the administration's Chrysler bankruptcy plan, the White House would use the White House press corps to destroy its reputation.
The White House and a spokesperson for the investment bank in question challenged the accuracy of the story.
"The charge is completely untrue," said White House deputy press secretary Bill Burton, "and there's obviously no evidence to suggest that this happened in any way."
Thomas Lauria, Global Practice Head of the Financial Restructuring and Insolvency Group at White & Case, told ABC News that Rattner suggested to an official of the boutique investment bank Perella Weinberg Partners that officials of the Obama White House would embarrass the firm for opposing the Obama administration plan, which President Obama announced Thursday, and which requires creditors to accept roughly 29 cents on the dollar for an estimated $6.8 billion owed by Chrysler.
Lauria first told the story, without naming Rattner, to Frank Beckmann on Detroit's WJR-AM radio.
Perella Weinberg Partners, Lauria said, "was directly threatened by the White House and in essence compelled to withdraw its opposition to the deal under the threat that the full force of the White House press corps would destroy its reputation if it continued to fight. That’s how hard it is to stand on this side of the fence."
A Perella Weinberg Partners spokesperson told ABC News on Sunday that “The firm denies Mr. Lauria’s account of events.”* The spokesperson would not elaborate.
Perella Weinberg Partners, which owned Chrysler debt through its Xerion Fund, was one of Lauria's clients in this bankruptcy, but no longer is. The firm is led by Joseph Perella. On Thursday afternoon -- after the Wedneday deadline -- the portfolio manager for the Xerion fund decided to join the larger four creditors who are owed roughly 70% of Chrysler's debt and had already agreed to participate with the administration's plan.
Those four financial institutions - JP Morgan Chase, Citigroup, Morgan Stanley, and Goldman Sachs -- are recipients of up to $100 billion in federal government bailout funds, though the Obama administration insists the matters were kept completely separate.
Someone familiar with the Perella Weinberg Partners' portfolio manager's thinking told ABC News that the decision to go along with the government plan "was based on an assessment of investment risk and reward and nothing else."
Lauria said his clients "are mainly fiduciaries for pension plans, college endowments, retirement plans and credit unions who invested in low yield supposedly very secure first lien debt" with Chrysler.
President Obama singled out Lauria's clients for criticism when he announced the Chrysler plan on Thursday.
"While many stakeholders made sacrifices and worked constructively, I have to tell you some did not," the president said. "In particular, a group of investment firms and hedge funds decided to hold out for the prospect of an unjustified taxpayer-funded bailout. They were hoping that everybody else would make sacrifices, and they would have to make none."
Lauria said the president's assertion that his clients weren't willing to make any sacrifice is false. The clients were willing to take 50 cents on the dollar from Chrysler for their debt, he said.
President Obama also said of Lauria's clients, "I don't stand with them. I stand with Chrysler's employees and their families and communities. I stand with Chrysler's management, its dealers, and its suppliers. I stand with the millions of Americans who own and want to buy Chrysler cars. I don't stand with those who held out when everybody else is making sacrifices."
"He stands my clients up as basically the reason Chrysler is going into bankruptcy," Lauria said. "He wrongly says they're not willing to make any sacrifice. And then he says he does not stand with us."
Lauria said the president saying he doesn't stand with his clients "kind of sounds like 'You're fair game.' In whatever sense. People are scared. They have gotten death treats. Some have been told people are going to come to their houses. God forbid if some nut did something, I'm just wondering how the president would feel."
The Miami area-based attorney describes himself as an independent, and says after waiting in line for six hours last November he ended up not voting in the presidential election. He donated $10,000 to the Democratic Senatorial Campaign Committee in 2008 and $1,000 to then-Sen. Hillary Clinton, D-NY, in 2006.

It is humorous to read above that if you protested under a Republican President you might "end up like the students at Kent State." First of all, as a Kent State grad, the comment is a bit offensive. Secondly, we did have a Republican President previously, there were tons of public protests against him and the war, and not ONE of those protesters was shot!
Secondly the protests at the RNC (to say "convention" again would be redundant) were not peaceful. Those that were not protesting peacefully were arrested. Those that were, were not arrested.
The level of intellectual dishonesty is disheartening!

Could there have been any real doubt or any surprise how any situation dealing with the interests of a national union's livelihood would not involve some sort of dirty tricks, intimidation, unlawful acts, undue pressure or strong arm tactics . . . especially if the honor of the Chicago political heritage is in play. And, as the financial, monetary and economic numbers really get twisted, turned and falter in a disfavorable way for the American people, how will the unions and the administrations behavior then be expressed.

Obama is taking America down the road to destroying freedoms as we have known freedom in the past. I Own Chrysler Debt & Have Lost A Significant Amount of My Own Retirement But Obama Clearly Does Not Care About Me. It is Obvious That the Obama Administration does not care at all about Investors. Ironically-Millions of Retirees Pensions Are Invested in Hedge Funds-but This President is a Populist President Who Will Do Anything He Thinks Makes Him Look Good. It's Quite Sad Really-He Destroyed Millions of Peoples Retirement Accounts Who Held Chrysler Debt While Appearing to "Save The People".

Attack Tapper and Lauria, but in light of the President's very public attack of Lauria's client and similarly situated Chrysler investors, there is ample reason to conclude Lauria's contention is true. Lauria claims his client was told if it did not go along with the President's restructuring plan, the White House would destroy its reputation. President Obama then very publicly does exactly that.

Listen to Frank Beckman's full 10 minute interview of attorney Tom Lauria that lead to the article by Jake Tapper. Then decide if you object to the admiinistration's strong-arm tactics.
The threat to use the White House press corps to destroy reputations is interesting and disturbing. Of much greater concern is the Obama administration's complete lack of respect for the U.S. Constitution. They have no respect for contract rights and they (executive branch) are intruding on judicial functions and powers.
Obama is following the path of Hugo Chavez. Use propaganda disseminated by a controlled media to smear an unpopular target, then ignore the law and constitutional protections to take private property and transfer it to the government or favored groups (labor). Liberals may cheer today's targets of this abuse (hedge funds, business, Wall Street), but think of how this misuse of executive power can be turned against you.

I doubt that the secured creditors would have received any more if govt had not subsidized bankruptcy. The hedge funds should have purchased more debt if they wanted to control the vote.

This story doesn't make any sense. Tapper fails to point out that he himself is a _member_ of the White House press corps that spends its time razzing Press Secretary Gibbs almost every day -- fairly in some cases or more often, unfairly.
This story sounds like yet another variation on the "liberal media" myth: In this case, that the White House press corps must be fawning over Obama even though enyone who's seen their press sessions with Gibbs (including Tapper) should know it's not true.
It doesn't say much for Tapper's critical reasoning skills that he hasn't considered this strong indication that he's swallowed a bogus story.
Aside from Tapper, nobody in the media but the lunatic fringe of the far right media (Fox, Limbaugh, blogs, etc.) seems to have given this story any credit at all.

Perella Weinberg said in a statement that the firm decided to back the government-proposed settlement Thursday afternoon, AFTER Mr. Obama criticized the lenders in harsh terms.
“In considering the President’s words and exercising our best investment judgment, we concluded that the risks of potentially severe capital loss that could arise from fighting this in bankruptcy court far outweighed any realistic potential upside,” the firm said, suggesting that its decision was based on financial calculations.
Charles, I'm sure that their decision had nothing to do with the fact that Rohm Emanuel previously worked for Perella Weinberg, and is now the Obama Hitman, not exactly known for his tact. I'm sure that it had nothing to do with the fact that Perella Weinberg is advising the Obama Administration on the disposal of toxic assets.
I'm sure there was no undue influence placed on them by members of the Obama Administration. No, I'm sure it had everything to do with the fiduciary responsibility they have to the clients they represent.

Tom Lauria, a lawyer representing “a small group of speculators” who forced Chrysler into bankruptcy because they wanted a few more cents on the dollar, made a stunning allegation against the Obama White House on a conservative talk show last Friday.
Lauria claimed that one of his former clients — Perella Weinberg — withdrew its opposition to the government deal because the White House threatened “that the full force of the White House press corps would destroy its reputation if it continued to fight.”
Lauria was not a first-hand witness to the alleged threat. Both the parties involved — the White House and Perella — disputed Lauria’s accusation. Nevertheless, ABC’s Jake Tapper reported Lauria’s claims, and his story was propagated on Fox News and Rush Limbaugh’s show.
Now, Tom Lauria is clamming up, refusing to stand by his earlier accusations against the White House. Neil Cavuto pressed him last night on Fox Business:
LAURIA: I have a former client in connection with this matter who is a client in connection with other matters who doesn’t appreciate all the attention that’s been brought to bear on that. So I have no further comment on that topic.
CAVUTO: Alright, well, this issue was raised by you. And now you’re not gonna talk about it?
LAURIA: I have no further comment. [...] I really don’t want to talk about this topic at this point. [...]
CAVUTO: You started out making a comment, and now you dropped it. It’s just weird, that’s all I’m saying.
This morning on Fox News, host Megyn Kelly tried another approach. “Can I ask you this? Have you made public statements that are untrue?” Lauria would not even dispute that he is lying. Instead, he said, “The truth is gonna come out.”
Lauria was asked eight separate times in two appearances on Fox to explain his earlier comments. And eight separate times, he refused to stand by his story.
The right-wing media will undoubtedly continue pushing the story, despite the fact that there are now no sources who say it is credible or defend it.

This is in keeping with most of what the big "0" does.When he was asked about his qualifications as president his campaign went all out to paint anyone who wants to know if the president was born in America as wearing tin foil hats. He has strongarmed and threatened his way into the office he was installed in and now is going to try his best to completely bankrupt the federal government and at the same time continue the mission toward global currency and global government.
I have a friend whose retirement is dependednt upon returns from an investment in Occidental fund. They are the people that the big "0" doesn't stand with and will lose much of their hard earned money because their retirement invesments are not something the big "0" will stand with.
Americans will long for the days America was in good standing in the world and our dollar was worth something.They will speak about the America before 0

Rahm Emmanuel, who made millions within a few months of retiring from the Clinton WH seems to be another generic little jerk with a napoleon complex. His fingerprints, along with ethics-challenged Steve Rattner (paid off NY pension fund agent, claims ignorance)are all over this.

Obama and friends seem to believe they are above any and all laws when they tell companies what to do......sadly Obama isn't able to deal with people who disagree with him.....I hope others will speak up..LOUDLY...to stop this guy. HE IS a threat to our way of life....call me paranoid...but you better start listening before you won't have ANY choices......THEY HAVE THE POWER AND THEY PLAN TO USE IT......how long depends on YOU and ME!!!
