Interview with the President: Jail Time for Those without Health Care Insurance?
November 09, 2009 6:30 PM
From Sunlen Miller:
During an exclusive interview with ABC News’ Jake Tapper today, President Obama said that penalties are appropriate for people who try to “free ride” the health care system but stopped short of endorsing the threat of jail time for those who refuse to pay a fine for not having insurance.
“What I think is appropriate is that in the same way that everybody has to get auto insurance and if you don't, you're subject to some penalty, that in this situation, if you have the ability to buy insurance, it's affordable and you choose not to do so, forcing you and me and everybody else to subsidize you, you know, there's a thousand dollar hidden tax that families all across America are -- are burdened by because of the fact that people don't have health insurance, you know, there's nothing wrong with a penalty.”
Under the House bill those who can afford to buy insurance and don’t’ pay a fine. If the refuse to pay that fine there’s a threat – as with a lot of tax fines – of jail time. The Senate removed that provision in the Senate Finance Committee.
Mr. Obama said penalties have to be high enough for people to not game the system, but it’s also important to not be “so punitive” that people who are having a hard time find themselves suddenly worse off, thus why hardship exemptions have been built in the legislation.
“I think the general broad principle is simply that people who are paying for their health insurance aren't subsidizing folks who simply choose not to until they get sick and then suddenly they expect free health insurance. That's -- that's basic concept of responsibility that I think most Americans abide by,” Mr. Obama said, “penalties are appropriate for people who try to free ride the system and force others to pay for their health insurance.”
The President said that he didn’t think the question over the appropriateness of possible jail time is the “biggest question” the House and Senate are facing right now.

I think that the president should keep doing what he is doing. Maybe we should have penalties for those who are not getting health insurance and can afford them. It is the same thing that they have done with welfare. You can only receive this service for only a certin amount of time. I think that we as a people should remember that u get what you pay for.

Isn't it funny how the only choice Democrats will protect is the right for men to pay for a woman's abortion?

Listen up America...This Bill has nothing to do with Healthcare. This is Obama's & Liberal freinds attempt to GRAB POWER! Think about this, if they control every aspect important in your life, like getting a job, loan, car, mortgage, education, health care, then don't they control YOU!!! Welcome to the Obama Dictatorship...enjoy!!!

First.
Comparing Auto Insurance to Health Insurance is INSANE.
A vehicle is a non living, non breathing object, that has no rights. We can CHOOSE whether or not we wish to have a vehicle, and if we choose to have one, and drive it, we MUST have insurance on it. ALSO, there are no examinations of our own bodies for getting Auto Insurance.
In contrast :
A person, like ME.. is.. A person? We HAVE rights, and we do not have the option to have or not have a body.. Another words, there is NO comparison. What this bill is saying, is basically, if you exist, and are functional, you MUST buy health insurance or face fines.. and if you do not pay the fines.. then... Jail/prison and or 250,000 fine
Also, being basically 'forced' to get health insurance is basically forcing everyone whom does not have it to find the cheapest company they can afford, and stand in line to have their .. *THEIR* bodies examined, their personal information given, and be subject to the rulings of that insurance company for maintaining their insurance.. i.e - physical examination every X months.. take this pill for this, take that drug for that.. or else they drop you.. And if they drop you because you didn't like what they were doing to YOUR body.. well you just fell into 'Non compliance' with the government law..
Further more, whom is the government to ONE - Tell me if I should or should not have Health Care - Two - Tell me if *they* feel I am capable of purchasing it or not - Three - If I *AM* deemed capable of buying Health Insurance, and I do not, force a huge, HUGE, fine against my wages, for something I DO NOT EVEN HAVE..
As far as the information circulating as of late that we *cannot* be sent to jail/prison for not having health care.. That is bull crap, anyone that looks can see between the lines here..
The truth is we CAN be sent to jail/prison for not getting Health Insurance.. The simple fact of the matter is that it takes not paying their ridiculous fines to land us in jail/prison for no having Health Care.. 2.5 percent of my yearly wages?? Are you kidding me? And for something I would not be spending a dime on because I didn't have it anyhow?
And on top of the Jail/prison time, up to 250,000 dollar fine as well?
Holy.. wow
I cannot beleive so many people are so ignorant to not see between the lines here.
This bill passes and we can all kiss America goodbye as we know it now.
And just wait, after this one goes through, wait until the next form of government control is attempted again by the Obama administration..
Pretty soon we will be walking around with bar codes on our wrists, limits to how many babies a family can have, and Gulags in the background housing everyone that did not comply with the governments mandates.
They can take my rifle when they pry it from my cold dead fingers.

I prefer to pay out of pocket? I always have. I am not taking a free ride and never have, in fact by paying out of pocket I have paid more than most people for their health care, even the insured.
I pay for when I need it, as I need it. No more and no less.

I can't stand listening to the lies from Obama and his puppets anymore!
I've been saying it for years....the problem with this country is IMMIGRATION. YET....Obama stalls on addressing the problem and refuses to close our borders or even so much as SLOW DOWN IMMIGRATION. Granted there are industries in this country that depend on immigrants but....we have 22 million illegals in this country and only 20% work in agriculture so what are the other 18 million doing? They are sucking us dry....bankrupting our cities our states and our country. They are depleting our natural resources and driving up the demand and cost of oil in this country. They crowd our emergency rooms and our schools driving up the cost of our health care and our taxes. When will it stop people?
Obama says we can't deport millions of people...WELL I SAY WE CAN....fact is it will be a lot cheaper than paying to keep them here and they can leave the same way they came....even if it takes 20 years...we need to SAVE AMERICA!

If this is sooooo good, why doesn't Congress use it for the next 5 years to show us first..........Then we can vote on it..........And why in the HE11 are illegals still coming in, time and again??? BECAUSE OUR PRESIDENT WANTS THEM HERE, THAT'S WHY!

Any other questions why health insurance is so expensive? While in medical training, I was working at a hospital observing a resident who was treating a young child with leukemia.
This child's family (illegal immigrants, as well as the boy) continued to cross the border to seek E.D. treatments for their son. They had been deported two months earlier, but had successfully made their way back and had brought him in because he was presenting with flu-like symptoms but could not rule out meningitis. Thus an LP (lumbar puncture) was needed to check his CSF.
The resident, who had performed dozens of LP's in her prior year of medical school as well as her residency years, was preparing to do it when the parents objected. They said they wanted a "real doctor," and in fact a "specialist" to perform the LP. Residents are paid through a special program from the fed government, administered via Medicaid. These instances are one of the primary reasons for the abovementioned program.
Instead, the chief attending physician had to be called up from home, had to make the long drive in, tying up an E.D. bed, nurses' time, the resident's, etc. What could have been completed in two minutes at a cost of $800 ended up taking in excess of three hours; cost over $4,000; and was completely written off by the hospital (a state facility) as "uncollectable."
This boy has already received over $100,000 in free medical treatment, all at our expense. Go figure.

Obama is a liar, dems reward bad behavior. If Obama wanted to punish people that did not pay their fair share, he should end welfare and other programs that reward people that do not pay their share, what a phoney. Are illegals going to jail for not having insurance ?

Here's an interesting analogy: we are vastly subsidizing the healthcare of illegal immigrants who take advantage of our E.D. system (no patient goes untreated) and thus, the costs are spread across all of us in the form of:
a) higher premiums
b) higher service costs
c) longer E.D. wait times
d) slower turnaround for tests, labs, etc.
My wife is a physician (pediatrician), and I am a public health administrator that runs a free clinic. Let me tell you a great example -- she has a patient in the NICU who was born at a mere 21 weeks of development. His parents (illegal aliens) insisted that "extraordinary measures" be used to revive him. Now, he is being kept alive on an extraordinary ventilator, and experimental feeding tube, etc. Eight weeks later, he is suffering from hydrocephaly, has had so many brain bleeds that he will never leave a persistent vegetative state, and he will never be able to breathe on his own without the aid of a respirator.
The parents refuse to even discuss end-of-life options, as they are devout Catholics (I am too, so I understand where they're coming from, BUT...)
The cost to keep this neonate alive in the NICU? $12,000 per day. These costs are all being absorbed by the hospital -- and you, and me, and everyone around us. His chances of ever having a meaningful life are <1% and, if he can ever leave the NICU, his cost of care will be in excess of $100k yearly, for the rest of his life.
Any more questions why your healthcare costs are so high?

I would be okay with people not being made to have health insurance as long as they signed a sworn statement stating that they would not go to an emergency room or doctor unless they had the cash to pay for the services so that the taxpayers (ie; me) would not have to pay their bill. I know of too many people who use emergency rooms as their primary care physicians because you can have the bills 'waived' based on your economic circumstances, however, they have jobs, just no insurance, or they get paid 'under the table'. Sorry, I am tired of paying for other peoples' health care while my own health insurance increases and my company provider tells us that we have to do wellness classes, loss weight, quit smoking, etc., to not have to pay deductibles. What about those people that just get to go to the ER when they don't feel good, what do they have to do?

Obama is ignoring the US Constitution!
"The U.S. Constitution is a limitation on the government, not on private individuals ... it does not prescribe the conduct of private individuals, only the conduct of the government ... it is not a charter for government power, but a charter of the citizen's protection against the government."

Since Obama became
president this is no
longer a free country. He
is a dictator worse than
Hitler. For those of you
who voted for Obama, or
even if you did not, go
to a website called Satan
worship in America and
hear what Dr. David
Manning has to say about
this man. Very eye
opening.

You cannot force a free man to do anything. I cannot believe that a good portion of you are actually toying with the notion of accepting a health care mandate. You have got to be out of your minds. Go ahead, keep rationalizing why this would be good for our society. Folks, this is how it starts. One more chip taken off the block called freedom. I can tell you this much, the law will not go unchallenged in the courts. This is huge. The 111th Congress is making a big mistake by adding a provision to the bill that would force us to buy health insurance. They'll be opening a pandora's box, and the old age question of who has what authority given to them by our Constitution will re-surface. If you don't have a clue, I'm referring to State Rights and the Rights of the Federal Government.

The car insurance analogy Obama uses to promote health reform is more apt than he may realize. Both are meant to lower the 'social cost' of certain activity. The trouble is, car insurance does not make for better drivers. If anything, it makes for mindless idiots, especially in no-fault states. Accidents are perceived as financial windfalls. Minmial damage can morph into a total loss. A sore back can win lengthy rehab or maybe disability. Since it always appears "someone else" is footing the tab, the larceny continues, and rates skyrocket for all drivers.
So it has been with health insurance. Originally meant to mitigate serious illness or injury, it is now used for every sniffle, scuff, and blister. Co-pays are cheap, right? Health insurance in the US is expensive and crappy because we use it as a subsitute for diet, exercize, and personal responsibility. We have adopted the ludicrous notion that our doctor ensures we remain in robust good health with a litany of MRI's, prescription drugs, and blood tests, instead of our own common sense.
Government intrusion into healthcare will lead to higher costs, lower quality, and less efficiency, as have all federally-funded programs. Only this time, we will pay for their incompetence with our health and well being.

bobfromphilly- It's is about as socialistic as requiring everyone with a car to have insurance, as everyone with a mortgage to have insurance. You have a life- Well you have to have life insurance.

Hmmmmmm, Legal Americans go to jail for not buying HealthCare. And Terrorrist come Live on American soil get 3 square meals a day, healthcare ,Citizens rights, and defense attorneys ALL FOR FREE! This is Obamas Change For America?
Posted by: EmbarressedAmerican | Nov 15, 2009 1:27:03 AM
I think health insurance should be mandated for everyone. Where and how you get it will differ but it's true that we taxpayers pay for the uninsured that end up in the emergency room every day to get free care. Let's clear out the emergency rooms and make healthcare more sensible - i.e., focus on cheaper preventative care. Either way, we pay.
I like Obama's plan but prefer a single payer system.
