Rove Defies Senate Subpoena

ABC News' Theresa Cook, Jason Ryan and Jennifer Duck Report:  A seat at a witness table in a Senate hearing room reserved for Karl Rove remained empty Thursday, as the White House’s top political advisor did not comply with a subpoena issued in the ongoing investigation into the firing of nine U.S. attorneys last year.

Rove's deputy J. Scott Jennings did attend the Senate Judiciary Committee hearing, though he was not able to satiate the panel's appetite for answers.

Jennings began the hearing by repeatedly declining to answer questions, invoking a claim of executive privilege.  Late Wednesday, White House Counsel Fred Fielding issued a letter to the panel, notifying its members that the President chose to exercise the claim of executive privilege regarding the testimony of the aides.

Jennings repeatedly answered, "Senator, pursuant to the president's assertion of executive privilege, I must respectfully decline to answer."

"It sounds to me like the American taxpayers are paying you to stonewall," Senate Judiciary Committee Chairman Patrick Leahy, D-Vt., told Jennings after his refusal to answer during Leahy's first round of questions.

Leahy called the executive privilege claim "bogus," and said the executive branch has shown a "total lack of cooperation" and has just been "stonewalling."

But Sen. Orrin Hatch, R-Utah, criticized the Democrats' actions in the ongoing investigation into the U.S. attorney firings.

"They chose to ask questions they know witnesses cannot answer and then they yell about a cover-up," Hatch charged.

"I wish that they had followed another course," Hatch said of the Democrats' wrangling. 

He said the result has been the "trashing of reputations and undermining of careers of hard-working career or public servants and the misleading of the American public about the proper relationship between the legislative and executive branches."

White House Press Secretary Tony Snow was asked in Thursday's press briefing why Jennings appeared before Congress, but not Rove.

When it comes to executive privilege, those who are not required to testify are those who meet on a regular basis with the president," Snow explained.  "Scott Jennings was not somebody who met on a regular basis with the president."

"On the other hand, when matters of executive privilege do come up, they're not compelled to give testimony or hand over documents," Snow added.

Snow's reasoning echoes the letter from Fielding, which specifically cites Rove, noting that he is an immediate presidential advisor and therefore is "immune and compelled from congressional testimony."

Congressional committees have also issued subpoenas to former White House counsel Harriet Miers, former political director Sara Taylor, chief of staff Joshua Bolten and the Republican National Committee.

Miers did not show up for a scheduled hearing last month, and the White House also declined to allow Bolten to turn over documents the members of Congress were seeking.  Late last month, the House Judiciary Committee voted along party lines to advance contempt charges against Miers and Bolten to the full House of Representatives.

Taylor did appear before the Senate Judiciary Committee July 11, but provided few answers, citing the President's directive. 

The RNC faced a July 31 deadline to respond its subpoena.  The House Judiciary Committee confirmed Thursday that the RNC is withholding some documents the committee is seeking, citing instructions from the White House.

I don't know about you,but I am feed up with the Bush Administration employees' attitude. They think that the rules don't apply to them. Issue a warrant for contempt of congress and put them(Rove Meyers) in jail. Reid needs to step up and deal with this bunch harshly or step aside and let someone else do it. These people have to respect you or they will walk all over you; Like they have been.

Right On Cliff Jones and Dave M! The Bush Administration is totally out of control and the worthless Dems are letting them get away with it! I'm wearing out my keyboard sending off
e-mails to Pelosi, Reid, and others to get hard-nosed with these arrogant power mongers. But, sadly, Nancy, Harry, and most of the Dems just don't have the stomach for the fight. After having suffered through LBJ and Vietnam and Nixon and Watergate, I can tell you for a fact that if we don't do something soon, we will have lost our great country and I am NOT being melodramatic. And btw--Edgar, you and your fellow Bushies need to remember that "Slick Willie" ain't the Prez these days. Unfortunately, he was NOT held fully accountable for his perjury AND he should have been. But that was then and this is now! Let's deal with the current morally bankrupt Administration, not the previous one.

people need to uderstand that the democrats do not have 30 votes in the senate and can not do anything to override a veto before you complain about them take a civics class and then get rid of the republican possum toters in congress that allow this disgrace to continue

Not once in the Constitution of the United States can I find the expression "executive privilege." But I can find the word IMPEACHMENT several times.

Yes, William, this situation with the Bushies running amuck IS a disgrace. And, okay, maybe Senate Democrats have a tougher time of it mustering up the necessary votes to be effective. (I still think they're gutless). But, what's Nancy ("Impeachment is Off the Table") Pelosi and company's excuse? Democrats control the House! Why haven't she and John Conyers begun impeachment proceedings against Bush and Cheney? (How about warrantless surveillance as a starter impeachable offense?) These people are all unbelievable! I think it's collusion. The "disgrace" continues and our elected representatives in the House shirk their constitutional duties. Yes, Gene, the word "IMPEACHMENT" is in the Constitution a half dozen times or so.
The House of Representatives needs to implement this process and SOON!

I love how Bush has made such a complete joke out of "Executive privilege". It is so unbelievably obvious that some shady stuff went down or he wouldn't be going through such measures to hide things. In 40 or 50 years or whenever the classified documents from this administration become declassified, we're going to find out some incredibly disturbing things about this disgrace of an administration.

Well you must not have been around when Clinton used his Executive Privilege to obstruct Kenneth Starr's investigation and to pardon broad host of criminals, including tax evaders and other cronies. He also tried to use it unsuccessfully to block the White Water investigation into various scams he and his estranged wife were involved in back "home" in AK. The fact that your President, a man of true faith, integrity and honesty, invokes his Executive Privilege in this and many similar cases is admission of no wrong doing. You could not be more off base. He is telling congress that running the Executive Branch is not their business. ...but you don't understand that because you get your information from the news bites and headlines written by campaigning democrat reporter types. Turn off the TV and think for yourself some day. This and many other "investigations" are ATTEMPTS to distract from their own INCOMPETENCE, FAILURES, LACK OF AGENDA and DEARTH OF IDEAS. ...which is why they are known as the FREAK SHOW ON THE HILL. ....and their biggest passion so far is to join with the enemy and INSIST ON FAILURE AND DEFEAT IN IRAQ in the name of political popularity points!

Doesn't frighten me a bit. See the truth and it will set you free! Also keep in mind that more then 9 out of every 10 blurbs you read are written by democrat reporters trying to get their incompetents elected. ....you'll view reporting the same way again...

We have a renegade executive branch that thinks it is above the law. Can't wait to see how historians rip Bush a new one. Mr Bush (I can't call you president as you don't deserve that title because of your behavior) you are an elected official and not some kind of potentate! Answer the peoples questions!!!

Future historians will document the colusion of the present day corrupt media and the Liberal Democrats. So no matter how they try to rewrite history today a factual account will ultimately be documented and it won't be flattering to prent day media.

How many times do you thinks the authors of our constitution have turned over in their graves since Bush took office? He and his henchmen have disgraced this country and our constitution. It will be interesting to see just how many years it will take to win back the trust that they have destroyed all over the world,if ever, let alone in this country. One day it will be proven that GWB was the worst thing to ever happen to the GOP and America.

In order to prevent Bush and his cronies from "running out the clock" I hope Congress installs a full court press.

Rove should be jailed ala Judith Miller until he agrees to spill his guts.

Furthermore, I would hope that a contempt citation would disqualify a person from further public service.

I don't blame Rove for anything. He is a conniving weasel, but that is what he is suppose to be. I respect a person for being himself. However, I don't respect Meyers or Gonzales. They are lawyers. By defying court orders and lying to Congress, they are going against what they are suppose to represent. They need to be brought to justice.

Why has this Congress not taken difinitive action, holding this administration accountable. The Republican Congress went forward with impeachment against president Clinton for mistating/lying about a personal issue between a man and his wife.

If Bush can continuously lie to the American People, emboiling us in a 'WAR', base on contrived and intentionally inaccurate information, then voice umbrage at anyone outing a CIA agent, promising to fire that person(s) to bring them to justice, only to PARDON the S.O.B. and protect those closet to him that clearly were the source of the leak. Then Bush 'LIED' to the American people and if the 'Oath Of Office' is not really an Oath, what is it. Tens of thousands of our Sons and Daughter have been sacrifice, killed, wounded, cripled, mentally and emotionally damaged, because of this calloused and selfishly motivated administration.

If this is not 'High crimes and Misdemeanors' what the *#!+? is?

Has the entire elected leadership in our 'Congress' bought into politics as usuall. Every American needs to contact there Representatives, in Both parties, as well as Independents, and make clear that they seve at our pleasure, not their own.

WHEN CONGRESS PASSED HJR 114 "AUTHORIZATION FOR USE OF MILITARY FORCE AGAINST IRAQ" WHAT CONGRESS DID WAS NOT A DECLARATION OF WAR. THEY BASICALLY SAID TO THE PRESIDENT YOU DECIDE WHEN WE SHOULD GO TO WAR, AND LET US KNOW LATER. THEY VOTED TO GIVE BUSH HIS VERY OWN WAR DECLARING POWERS, THEY ARE GUILTY OF VIOLATING HIS/HER OATH TO UP HOLD THE CONSTITUTION, ALSO GUILTY VIOLATING 18 USC 241- CONSPIRACY AGAINST THE CITIZEN-RIGHTS OF U.S. SOLDIERS TO BE SENT TO WAR ONLY" ON EXPRESS ORDER OF CONGRESS.
NOWHERE IN THE CONSTITUTION IS ANY BRANCH EXCEPT CONGRESS GIVEN THE POWER TO DECLARE WAR.
CONGRESS KNOWING THEY COMMITTED THESE CRIMES AND GAVE BUSH THEIR WAR POWER.
