Judge Dismisses DNC Lawsuit Against McCain

ABC News' Tahman Bradley reports: A federal judge today dismissed a lawsuit filed by the Democratic Party that tried to prevent presumptive Republican presidential nominee, Sen. John McCain of Arizona, from opting out of the public financing system. The Democratic National Committee had asked that the court force the Federal Election Commission to take action against McCain, saying he had already made use of the program by securing a bank loan on the promise of public money.

Judge John Bates wrote in a five-page decision that the case is the FEC's to decide, and even though the commission has been unable to obtain a quorum for several months, the matter still remains in their jurisdiction. Federal law requires a party to file a complaint with the FEC and then wait 120 days before filing suit, Bates, an appointee of President Bush, pointed out in his ruling. The DNC complaint, which asks for investigation of a bank loan agreement the McCain campaign entered into with Fidelity and Trust Bank of Bethesda, was filed in April.  Before the FEC's quorum troubles, the panel asked the McCain campaign to explain the agreement.

Republican National Committee chief counsel Sean Cairncross applauded the decision in a statement. "The Court’s order confirmed what the McCain campaign said at the time the suit was filed; the DNC lawsuit was nothing but a frivolous publicity stunt."

The McCain campaign did not offer comment.

McCain requested and received approval for public financing after his fundraising slowed last summer. When the campaign got back on track early this year, McCain wrote the FEC saying he was no longer interested in public money. Candidates who opt into the public financing system must adhere to spending limits, and such limits would put McCain at a big disadvantage if the Democratic presidential nominee does not use public money in the fall.

The DNC doesn't think the matter is over. "Unless there is a serious and timely investigation under way by the FEC, we will be back in court in the end of June to hold McCain accountable for breaking the law," spokeswoman Stacie Paxton said.

Seems to me McCain already beat Obama at his own game... with no petition sigs to challenge, Obama can't just eliminate this competition... Of course, Obama might try to humiliate McCain (and his ex-wife and children) by having his divorce records unsealed, as Obama did to his last opponent in '04. If Obama doesn't come up with some dirty trick, Obama may actually have to compete the old fashioned way - on the issues. Sucks to be him.

Poor Obama... He's going down. And thanks to that pedestal in the sky he's been propped up on, it's gonna be a long, long fall. Pick on McCain all you want - he has more integrity, character and honor in his little finger than Obama's got in that big fat head of his. November 6, I'll be thinking about all his Obamabats (and LMAO!!!), when I hear "President-Elect McCain." HUZZAH!!!

Obama's opponent in '04 was Alan Keyes, and there was no mention of divorce. The sorry excuse for a republican Keyes didn't need any help destroying any chance of winning that he may have had. Keyes did that merely by opening his mouth. And as for competing cleanly, instead of spouting the tired republican talking points full of propaganda, do some legitimate research and find the truth. His campaigns have consistently been run cleanly, even when his opponents have attempted to turn the race ugly.

If you even remotely believe that McCain has honesty and integrity, you're blind and brainwashed. He's changed all of his position to attempt to match his potential voters, he's an ex-POW that won't vote against torture by the U.S.A, he's an ex-miliary man that refuses to support the GI Bill because it may cause people to not re-enlist, he's involved with many lobbyists and PAC's, he's skirting the laws of campaign finance reform that he co-sponsored, the Keating Five "issue", the Boeing/Airbus issue, starting fist fights with other Senators, cussing out his wife on stage... If you'd like I can keep going, but I thought you may have gotten the point by now.

Funny how you believe McCain to be clean in spite of all the evidence to the contrary. So, brainwashed or blinded?

Guess all the people posting the typical propaganda based on lies and half-truths didn't want to play any longer. No fun when someone points out the facts I guess. Oh well, plenty of other blogs with filth being spewed to go post on.
