Injured Vet Suing Filmmaker Michael Moore Would Go Back to Iraq

The injured vet who is suing filmmaker Michael Moore for $85 million has long supported the war effort and says that he would go back if he could.
"I'm proud to have served my country," he told ABC news in an interview in 2004, "and if I could still go over there and do something, I would be doing it today." Damon also had high remarks regarding the medical care he received at Walter Reed.
In a lawsuit filed this week, Peter Damon says he did not authorize Moore to use a video clip of Damon while he was in the hospital. Damon says the clip, which was used in Moore's hit "Fahrenheit 9/11," gives the false impression that Damon is criticizing the war effort.
Damon's attorney, Phillip Moran, claims that Moore used Damon for his own private political agenda. "The inference that Mr. Damon was opposed to the war is outrageous and an abuse of the man's privacy, and it is a terrible, terrible thing."
Damon was interviewed by NBC News' Brian Williams while heavily sedated in the hospital awaiting surgery. According to the suit, this footage was used by Moore in "Fahrenheit 9/11" in a misleading way because Damon appears to be complaining about the war effort when he was actually explaining the benefits of a new pain blocker being provided to wounded servicemen.
Damon says he objects to the use of the footage because he agrees with and supports President Bush and the war effort. The suit claims that as result, Damon has suffered emotional distress, embarrassment and personal humiliation.
The suit also names Harvey and Robert Weinstein, Miramax Films, Lions Gate Films and NBC as co-defendants.
If Damon's suit is successful, he says he will donate the money to veterans' groups. Recently, the group Homes for Our Troops provided the Damon family with a new home with handicap accessible features.

Anybody that would support Bush as he crushes our military is not thinking at all. This young man we grieve for even if he disassociates his misery with the man Bush that brought it to him and attacks Michael Moore. What do you bet the "swifty boat pig group" are backing this effort?

Umm, you have a First Amendment right to oppose the war, which this injured vet has helped to protect through his service.
How about we have equal respect for the other laws of this land that protect private citizens from manipulations by self serving slimeballs like Michael Moor

As a resident of Flint michigan, Politics aside-this is what Michael Moore does-Portray people to suit his view through creative editing. I have many friends that have suffered the same indignities by Moore in "Roger and Me" making good civic boosters look like rich pigs-Shame on Michael's constant bottom feeding and twisting others words to back up his so called documentaries.

70% of the country has come to the same conclusion as Michael Moore and the Dixie chicks (Is he suing them too?).
As a veteran of 2 wars I will only say that anyone who would want to go back into a combat zone has not seen serious combat.

Obviuosly, Mr. Damon doesn't see it that way. By filing this lawsuit, he has dishonored his own service.

Uhhh, yeah, now that he thinks he can get money out of Michael Moore he says he is for the war. It's been almost 3 years and now he is bringing this up? What a crock.

Steve, why do you say. "Michael Moore is free to hate our great nation"? Moore hates what has HAPPENED and is HAPPENING to our great nation, which is quite the opposite. Some of the artistic liberties he takes in his films can be somewhat misleading, but they are mostly factual when you get down to it.

I am wondering why this irate young man has waited so long to sue. Has he spoken up before? My guess is that if Michael Moore had been advised as soon as the movie came out that he had made a mistake in using Brian, he would have apologized and edited the film for future editions. didn't he have to have permission to use the clip? did this young man not know he would appear in the film?

moore licensed the footage from NBC. If whatever waiver the guy signed says he's giving the rights to the footage away, then he doesn't have any legal grounds for the case.
I think his lawyer's assertion that the clip makes it look like he's complaining about the war is NOT accurate at all, if you watch the clip it is talking about the realities of wounded veterans, of which Mr. Damon is one. All he's doing in that clip is describing the seriousness of his wounds. If Moore said "All the veterans in this portion of the film are anti-bush/anti-Iraq war" then that would be dishonest and misleading.
Lastly, if my information is correct, Mr. Damon lost his arms in a helicopter maintainence accident(in a combat zone, ie Iraq), not "in combat" (not from an enemy bomb, etc). Which does make the use of his clip in moore's video seem misplaced from a correctness point of view (that accident could have happened in peace time anywhere else in the world I'm assuming?) but thats not grounds for this lawsuit.

How come a guy who was outraged by Michael Moore to the tune of $85 Million stood next to Ted Kennedy at his ANT-WAR, ANTI-BUSH speech at the Center for American Progress (LIBERAL think tank) in 2004?

I'm afraid "mostly factual" doesn't cut it in documentary films. it is...or it isn't true. Otherwise..It's not a documentary-It's a fictional account. He never deserved an Oscar for best documentary. I know-I am a filmmaker AND have worked with Mike before. I know his motives better than most. PS I am a Democrat!

I feel bad for this soldier. My nephew was in Iraq last year, and so happy to be home. He said, MOst guys hate it,a nd don't want to be there. They all think this war is ridculous. Let's see the rich are getting richer and middle class, Hey do we have one anymore???? I think I'm about to go into poverty soon!!!! Rich are getting richer and young men dying for nothing!!!! this is crazy!!!!!! PS I changed from Republican to Democrat before last election......
