Instant Messages Obtained by ABC News Cast Doubt on Claims from Foley's Lawyer

Mark Foley was sexually molested by a clergyman when Foley was between the ages of 13 and 15 and "wants you to know he is a gay man," his lawyer, David Roth, said late Tuesday. Mr. Roth said the disclosure was part of his client's "recovery."
Asked why the former congressman did not reveal this information sooner, Roth said, "Shame, shame."
"As is so often the case with victims of abuse, Mark advises that he kept his shame to himself for almost 40 years," Roth said.
THE BLOTTER RECOMMENDS
Foley, who checked into an alcohol rehabilitation facility in Florida, also "reiterates unequivocally that he has never had sexual contact with a minor," Roth said.
But instant messages obtained by ABC News do reveal that Congressman Foley met with an underage page in San Diego, a meeting which they spoke about in an instant message exchange from April, 2003.

Roth said he knew but could not reveal the name and denomination of the clergyman who molested him. According to Foley's biography on his Web site, he was raised as a Roman Catholic in the West Palm Beach area.
Foley's lawyer said Foley takes responsibility for sending sexually graphic instant messages over the Internet and was under the influence of alcohol when he sent many of the messages.
He denied, however, that Foley ever offered to provide alcohol for teens at his Capitol Hill apartment.
But according to an instant message provided to ABC News by a former page, Foley did make such an offer to a former page in April, 2003.

It seems to be a spider's web of lies. Hastert says one thing, then another. He can't remember. Foley suddenly is a molested alcoholic. It sure sounds like people knew, or should have been smart enough to know that there was something evil going on...but NOTHING substantial was done.

It is unlikely that someone goes fishing for 5 or 6 years (that we know of) and never catches a fish. All of his IM's are trying to get an underage person to meet him for sex. He must have been successful at least a few times, or he would not have continued. I think we are only seeing the tip of the iceberg. I also believe that this may be a common practice and that is why they are covering it up. I don't think it was only him. There is much much more to this story, and it is going to be the biggest scandal we have seen in a long long time.

As a true conservative who has never had a problem with individual liberties such as gay rights, I think this new "news" is appalling.
Now Foley is an abuse victim and is gay. Yeah. Play the trauma card. Did Rove write his statement? Seems to me that the Republican leadership is still suffering from an '04 hangover. When in doubt, try to demonize gay people. It worked well in '04 so why not try it again?
When will most Americans wake up and realize that being "conservative" is not about the bible? It's certain principles. Less government and more citizen responsibility.

As a mental health professional, I've been bothered by the recent misuse of the word "pedophile" by the media and others. Pedophilia refers to a pattern of attraction to people who are physically children (ie prepubescent), and has nothing to do with age of consent laws. My understanding is that the minimum age for pages is 16. While sexual contact with 16 year olds is against the law in many states, it does not make one a pedophile.

Funny how the Republicans that made such a fuss out of the Lewinski affair are now complaining about the publicity the Foley business is getting. Personally, I think there is a difference between consenting sexual encounters among 2 adults and an old geezer abusing his power position to get hot on young boys. Foley, and only Foley, is responsible for his actions. The Republican party is not responsible for the things that he did. He used his position to take advantage over young men that aspire to serve this country. All those that were aware of his acts and seeked to cover it just to hold a seat in Contgress should step down and be sanctioned. I just hope he never got to do anything with these young people, although I believe by reading one particular IM that he met at least one and offered to provide him liquor in his house. shame on him.

What I want to know is, would everyone be as upset if this were a young GIRL? Although that would be as bad as this is, I somehow think that because it was a young BOY this is getting more coverage. This is so sad because this guy is a monster and should be put away. For him to "blame" alcohol and claim to have been molested as a youngster is even sicker.

Gee, of course Mark Foley is not lying to the public when he claims to be a molested alcoholic who never had improper physical contact with a minor. Why should we doubt him? All his other lies certainly don't illustrate a pattern? Of course, based upon Foley's claims, we should feel sorry for him, because he is obviously a victim here in claiming he is the only one who was ever molested.
No wonder the GOP leadership ignored the red flags and is blaming the Democrats for this scandal. Not accepting responsibility for anything seems to be one of the "core values" nowadays for Republican. Sick.

How clever of him to tell us of his alchohol problems and to sign into "rehab" and have this come out at such a convient time. I'm sorry, I don't buy it either. What's important to remember is that we can only make judgements about what we KNOW not how we choose to connect the dots. The guy clearly was into lascivious with chatting young boys, and we can make a judgement about that. But, so far, there is nothing other than a reference to San Diego that indicates it went any farther than that. So all those who choose not to connect just existing dots, but imaginary or hypothetical dots as well, are doing not Foley but justice a disservice. Maybe the guy got off talking naughty on the net but didn't take it further--who knows . . . we certaintly don't. And while there is certainly something perverse about nasty messages, there's a huge gulf between that and real life behavior. Let's judge this guy by what we KNOW he's done, and hold off condemning for what he MAY HAVE done until we get facts there.
If those same facts show that the people in charge of things on the hill knew what this guy was up to and looked the other way--which again is still not certain--then they should be slammed hard as well.

I dunno - Mr Foley makes a point of 'splaining how he was victimized (and we assume, traumatized) as a young teen by a person of authority and trust, then dismisses his own actions because he didn't have a "hands-on" encounter (we are to believe)?
Honestly, as the parent of a sex offender, I am more than familiar with the "its-not-my-fault" mentality. Sexual predation is not a black and white issue, but real responsibility for one's actions is definitely the best first step!

Where there's smoke, there's fire! I think someone will come out of the woodwork eventually and tell of their inappropriate sexual relationship with Foley. Foley is a predator and didn't just develop an attraction to boys within the last few years. To think that he only satisifed his sexual urges with instant messages and e-mails would be niave. Foley knows those he abused and knows that if they come forward to tell their story then he is definetly going to jail. This is a man who is desperate and I wouldn't be surprised if pressure has already been put to those he abused to keep quiet.

I was molested when I was six years old and I have never molested other children. Nice try Foley, but this isn't going to work. If anything, you would have know how deep the scars run from being a victim and you wouldn't have victimized other children yourself. The fact is that you are a pedophile and you used your power to groom teenaged boys so you could gratify your own desires. You are a sick man, but I don't feel sorry for you. Blaming this on alcohol and being a victim this late in the game makes you more despicable than I already thought you were. ABC news still have not revealed how they have verified that the AIM chat transcripts are valid. Nor do they make a distinction between chat transcripts and the email that was sent by the former Congressman. I have called Brian Ross' office several times and no one in his office will comment on how they verified the chat transmissions.
Let me explain for those that don't understand the difference. All emails have a digital signature that can be traced back to the sender. These transcripts from the AIM chats are mere text files that can be manipulated.
If all ABC NEWS has are these "chat logs" then it is basically a he said, he said thing.
As a user of AIM for nearly 10 years I have saved chat logs all total of 2 times. I know no one that saves chats files so I question the validity of the 52 chat transcripts.

But, I'm just a middle class working single mom trying just to live a good life and teach my kids right from wrong. Paying bills, living paycheck to paycheck, is easy compared to trying to teach kids what's right, wrong, moral or immoral when you see the leaders we have had as examples in our country.

To be a Congressional Page you must be 16 years old. To have consenual sex in DC you must be 16 years old. I see no laws broken and a lot allegations of wrong doing. Where is the proof? Mark Foley has, perhaps, distastefully to some, engaged in relations with those who by nature must be of legal age to do so in the District. Change the law and increase the age of consent if you think these kids are being abused by power and sex hungry pols. For that matter, lets outlaw sex in Washington. Otherwise, give me proof he propositioned underaged kids in DC....UNDER 16 and with criminal intent....or move on to the next story.

Thank you ASurvivorInUtah. As you will know, one of the things that is really showing up in the Foley scandal is the extent to which the culture of enabling is alive and well. I was a victim of the priest Tolkien, son of J.R.Tolkien of Lord of the Rings fame. He too had the power of money and the Catholic Church to which he was giving $mmm form the inheritance from his father. Power and money continue to weave a screen around these criminals. In the case of my abuser, his prosecution was put off again and again until he eventually died without even being brought to court. The sick paradox is that all those children who paid money for the books and the movie unknowingly funded his escape from punishment. Hundreds of his victims were terrified ever to come forward because of the campaign of his lawyers and the Cathilic Church. Seem like deja vu all over again except this time in the Church of Congress. Meanwhile, I am in my third year of therapy at 60+ years old with a broken life behind me. And like you it wouldn't occur to me to abuse children.

I did think of one way to authenticate the chat log transmissions. When the file was created the computer has a time stamp as to when the file was created. I would like to know if ABC was given access to the victim's computer.

In a society which boasts protection of democracy around the world, we seem to have no problem trying people in the press. What happened to innocent until proven guilty? We have already found Mark Foley guilty of and exercised "diagnosis" of a psychological disorder which he clearly does not have. Foley is not by definition a pedophile. According to the DSM IV diagnostic criteria he does not meet the essential requirements, at least by the information the press has reported. Granted, adult relationships and sexual overtures are frowned upon in our society but how different would the country's reaction be if the same emails were from an alleged drunk man to a 16 year old girl? How many times have we seen heads turn by "adult males" to look at under age females, i.e. high school cheerleaders? The double standard is clear. We are a confused nation. If we are going to fight wars around the world claiming to defend democracy we need to start at home and practice what we preach.

ASurvivorInUtah: No one has challenged the validity of the chats. Sure they are somewhat questionable, but Foley would not have resigned if at least the general tone was true. I imagine he is not so much a coward that he would resign instantly over fabricated AIM messages.
BTW, I log ALL instant message conversations. Most clients do this by checking a box, many by default. A 17 year old kid would know this, since it's a primary means of communication and they often want to go back and read what people said. This would especially be true if you were chatting with a Representative.

1) Why didn't hastert, boerner, etc. tell the democrats, the media, and us about this pedophile months ago? Seems like they, and Rice too for that matter, just can't seem to remember their
powerlusting incompetency behaviors. That lust for power has corrupted the entire leadership.
2) GOP has been in control for years. Why have they let the Ethics committee die? eg - Foley, Ney,
Cunningham, Delay, Lewis, at al. None have faced ethics violations.
They've really enabled a large group of criminals and crooks. This is much worse than the check cashing scandal the Dem's allowed. Time for the GOP to be swept out.
3) If Foley was drunk, let's check his emails and im's for grammar,
syntax, and punctuation. Just like driving, drinking will impair the
typing and thought processes. Curious to see them analyzed in this way.

The first sentence of this report should be clarifed. ABC News has not confirmed that "Mark Foley was sexually molested by a clergyman when Foley was between the ages of 13 and 15" - that is Foley's allegation.
Also I agree that ABC News should say if they got the messages from the Pages or an independent source. Suppose one of the Pages was faking messages or e-mails?

Amberlynne - I can't answer that, I know what I would do but I have never met, or for that matter even heard of this guy before Friday. It certainly doesn't look good for him, I would just like ABC News to have all their facts in line and disclose how and when they found this information.
I still believe that the law of the land is that a person is presumed innocent until proven guilty beyond a reasonable doubt.
Considering how in recent years the mainstream media has reported inaccurate news stories near election day I am slightly skeptical. It would be nice that someone would do their homework once in awhile, but the mainstream media is just lazy and we the viewers are suppose accept what they report without questioning them.

dude, my IM saves all my messages all the time. I have all my IMs dating back years and it's neither difficult nor confusing. it's a simple setting on my messenger.
in fact, I don't know anyone who doesn't save their IMs.

While it's true the age of consent is 16 in D.C., these pages were not contacted until they had gone home and we do not have all the places where they live to know the laws in those states. I think we all need to wait and see what the investigation turns up to determine whether or not laws were broken, and which laws apply to the internet. People who are brushing this aside need to take a step back and wait for the facts.

That's the problem. You're a user, Not an admin. Perhaps you aren't aware that your chat sessions can be logged on the server without your knowledge.
He isn't denying it because he knows they are legit. Do you really think he would have resigned over a few suggestive emails? Not a chance.
Is it just a bit ironic that the laws he sponsored are the ones he violated and can be prosecuted under?

I find it interesting that Mark Foley heads to an alcohol treatment facility upon his being outed for his sexual predatory behavior on kids. Alcholoism doesn´t ¨cause¨ pedophilia. Alcohol abuse is the result of suppressed conflict and/or anger and one´s predisposition to getting the disease upon exposure to the trigger, or alcohol. His actions are despicable no matter what, but particularly so in light of the fact that he was a person in a power position. I just hope America wakes up to these self-righteous right wingers who walk around preaching purity and moral values while they molest our children while doing so. A hypocrite is worse than a liar. Vote them out and start fresh.

Mr. Foley has admitted his guilt by his words and his actions. A full accounting of the unsavory facts is necessary to put this matter to rest. Even if 16 is the age of consent in DC I doubt very strongly that families are particularly interested in sending their kids to Congress to be preyed on by people who hold power over these children by age and position. We're talking about a 54-year old male and a sixteen-year old boy, remember? Give him his day in court and let's see what ensues.
Now the second question is whether Mr. Hastert or others shielded him from exposure. That would be criminal too.

Consider for a second that the man resigned in disgrace. You don't resign from a power position unless you are (a) guilty as sin and usually also (b) caught red handed.

Wow, convincing argument! I know plenty of people who save chat transcripts. Doesn't seem unlikely to save one where your perv boss is coming on to you - just in case you need it in the future as evidence.

Thank you Amberlynn you are absolutely right ! Yes, why would he resign if it wasn't true or if he wasn't caught red handed so to speak. By that I mean he knew the jig was up because he knew investigators would seize his PC and examine the hard drive. And YES, Jay you are probably right in your 2nd comment. We won't know how Ross got the information until his investigative reporting on this is over but then he might not want to reveal his source. Remember Ross just asked Foley some questions when the guy up and resigned not knowing 100% if the transcripts were in fact from Foley. Looks like he got his answer.

A 52 year old man having sexual relations with a 16 yr old boy is not normal, let alone a 52 yr old politician with a 16 yr old under his 'care'. Let's look at this situation for what it is, a sick act by a sick person. It was wrong for the President to have sex with Lewonsky, it's wrong for a congressman to have sexual relations with a page. Let's not cloud our judgement based on our political point of view.

These conversations do not appear to me to be the words of a man who is just "chatting" with some underage males, rather the words of a man soliciting sex. I can't believe he maintains that he did not have sexual contact with these kids, pedophiles dont just have conversations, they molest.
Either way, I'm glad he's not in the House any longer.

I was molested several times as a younger person, should that be okay for me to molest some one because I was? does that make me gay? personally it makes me physically ill to even think about it! I would never do that to another human being.
questioning your sexuality is one thing, but actually going after a child, someome under the age of 18 just because it happened to you does not give you a right to do the same. If it was any one else, they would be in prison.
It is wrong, plane and simple!
He should not expect any special treatment just because of what has happened in his past! he knew it was wrong, but he continued to do it! it happened to him, he should know how it feels!
Foley should be put in jail, and the others who knew about it should also be put in jail for covering it up, no matter who they are!
This is a disgrace, and I think that these people are the reason why there are so many laws are being held back!
they all should be blocked out of any government office! and should be put in jail.
