Not Guilty Plea in Phony Hero Case

Mike_weilbacher_nr_2 The St. Louis businessman accused by the FBI last month of being a phony Marine hero entered a not guilty plea in federal court.

Michael Weilbacher, 48, was charged under a federal law that makes it illegal to wear Armed Forces medals without being authorized.  If convicted, Weilbacher could face a maximum sentence of six months in prison and/or a fine of $50,000.

"He was wearing the Navy Cross, two Silver Stars, four Bronze Stars and just about every medal in the book," said Major William G. Dragan, who attended the recent Marine Corps Annual Birthday Ball and immediately became suspicious of Weilbacher.

 

"He boasted of getting his Navy Cross by leading a secret mission against drug cartels in Colombia, which seemed very strange to me," Dragan told ABC News.

Weilbacher's girth also raised suspicion, Dragan said.  "He is massively overweight, something like 400 pounds, and yet he claimed he had just left the Marines, which did not add up because he could never meet USMC physical standards," Dragan said.

Federal authorities say there is no record Weilbacher ever served in the Marines.

Weilbacher may be the last person to be prosecuted under current statutes.  Just last week, Congress passed "The Stolen Valor Act of 2005," which makes it illegal not only to wear unauthorized medals but also to make verbal or written claims of being a recipient of military medals.

Weilbacher, who was released on bond shortly after his arrest, is scheduled to go to trial on Jan. 18, 2007. Weilbacher, through his attorney, said he had no comment at this time.

I've always believed that jails & prisons are full of totally stupid and selfish people, and that's exactly where this guy needs to be. He's really being a wuss, he should be a Real Man and take responsibility for what he did, and plead guilty, then go to jail. After all, that is exactly what every person in the military is taught to do. I also think that he should be sent to Basic Training after he serves his time in jail. Maybe then he'll learn that heroism cannot be faked or bought - it comes from the best part of a person's heart and soul. Right now I don't think that this Fat Faker has either of those. (Heart, soul)

Send this Marine "Wannabee" to Parris Island South Carolina for 18 weeks and let him earn his uniform and medals the old fashioned way. If this 400lb tub of bacon grease can make it there, then pin the Silver Star back on his chest. (not)

As the mother of a soldier who is recovering from being shot in a sniper attack during his second deploment to Iraq, I wish they would send him to the middle of Baghdad where my son and all the other soldiers there are truly risking their lives every day. I would like to meet this man face to face just one time! Please remember to pray for our soldiers and their families during this holiday season.

The Stolen Valor Act is another stupid law passed by Congress. Sure, this guy may have acted foolishly, but did he really harm anybody with his actions? No. I find it doubtful that our Marines, who are fighting for our freedom in Iraq and Afghanistan (though they should have seen through this government lie by now), would support such an authoritarian act at home.

I'm really interested in learning why this man chose to wear the medals and make the claims. Our fighting men and women deserve better, which is why the "stolen valor" law has been passed. What excuse could he possibly have for trying to pass himself off as a hero? He should get fined, and the money from it should go to support the families of our true heroes!

it's strange how he did that. did he not think someone would be suspious. to have that many bages all at once, very strange.

As a veteran of the US Army, member of the American Legion, A friends with many real Marines, I can tell you yes they would support this. Some jacka@@ running around claiming to be some kind of BS hero takes away from those who really do put their lives on the line. You, it would seem, have never been in th military and could not know what those medals mean and what it's like to offer your life for everyone else. Even people like you who don't respect what we do.

If convicted, would this person be eligible to serve his time at a military prision? How about Portsmouth Naval Prision where he would be cared for by those he chose to impersonate ~ US Marine guards. That ought to be interesting.

I understant how the stolen valor law has come about. But, why put him in prison? Who has he hurt? Why do I have to spend my tax dollars on him? he is overweight, and most likely unhealthy, now we as tax payers have to pay for his housing, his medical bills, and feed him...boy this is really teaching him a lesson on lying...

Throw someone in jail for impersonation? You support this? Is this the type of "freedom" that our soldiers are dying for overseas? Think about it.

This guy has screwed up majorly. I don't support the war, but I think the troops deserve respect. As this man is not one of them as he claimed to be, yeah, he should be punished, but not with jail time. Fine the crap out of him and send it to the families of the troops.

When you think about it, it is really sad. He wants to be what he can't be, so he lies. He is caught - now he is totally discredited, still fat and still not able to be what he wants to be. As a former Marine who does have a Silver Star from Vietnam, I think that instead of sending him to jail, he should be made to do public service of some sort that will do some good. Jail won't accomplish anything.

I am in the Navy and my husband is a Marine for those of you thinking that this is a crime that doesn't hurt anyone you should talk to those who have earned those medals, oh wait you can't because most of them die to earn those. My uncle was a POW in Vietnam and my father is an ex-SEAL I have both of their medals that they earned to remind me of the America I want to live in. He should be sent to a boot camp and then put in the worst situation possible to earn what he was wearing.

Having just gotten out of the Marines myself, this story hits home for me in a saddening way. I was in for 6 years, served in Iraq, and earned my share of medals including the NAM. We all work hard for our awards, and it sickens me that just anyone can waltz into the local army-navy store and purchase any medal to wear around like you actually did something in life. The only thing he deserves is a medal in obesity. I'll be happy to make one out of burgerking wrappers for him.

People like this guy dishonor those men & women who distinguished themselves by their patriotism and often being left with scars from wounds or the ultimate sacrifice: their lives. People like him disgust me. I know nothing about him except from what is printed above. But this is the USA. He deserves his day in court. If found guilty, I hope he is humiliated by having his medals removed on national TV and his name to become synonymous with people who dishonor themselves and their country. He is a phony, a fake, and a fraud. He should be fined as a message to others who do the same.

Not to defend this idiot, but there is a little over-sensitivity by some marines out there as well. I was wearing a USMC hat (unofficial), and was told that it was disrespectful for me to wear this hat, not having been a Marine. I told the gentleman that I didn't play for the Detroit Tigers, but I showed my support by wearing thier hat at times too. He asked that I take it off and not wear it in the future. I had made absolutely no representation regarding my status as anything other than a civilian fan of the USMC. So there is a little over-sensitivity out there as well.

The food at that Marine Corps Annual Birthday Ball must be pretty good. Judging by the size of this guys gut, I'm guessing this wasn't the only free booze and food he's guzzled down while wearing a uniform.

Those of you who say this guy's offense of impersonating a Marine and illegally wearing medals was a "victimless" crime are showing your lack of respect for our military. It is also disrespectful of those who legitmately earn such medals by risking life and limb in defense of our country.

This is no more a victimless crime than someone who wears a fake police officer's badge or someone who poses as a doctor or other professional.

Also, those who use this incident as yet another excuse to "Bush bash" and/or the war on terror are really off-base. Such comments malign the integrity of those serving in Irag and Afghanistan. They go where they are sent and do their duty. (Something most of the libs will never understand).

Finally, although he truly deserves it, the guy will likely never see active time. More likely, a stiff suspended sentence, a fine (heavy, like him, I hope), probation and community service can be expected. That way, he can maintain his "food habit" at his own expense!

After long thought on this topic, I originaly wanted him strung up and put away, but the thought of wasting money on his worthless *ss was harder to bear. I think a good round of heavey public humiliation would hit this pig much more than jail. Also him being a buisness man let the court of public opinion in the work place hit him right in the wallet.

This Is just SAD! This guy pretends to be a Marine at the Marine Corps Ball? Dumb , real dumb. I have several friends who are Marines. One is in Iraq right now. My grandfather earned a medal as a marine on Iwo Jima. I sadens me that some one would do this to those who served their country. In my opinion, I think he should be fined and have to go to every Marine Corps Station in the US and apologize to the Marines. Think about it, that would be quite a humbiling experiance, if not practical.

Now that they've popped this phony "hero", they now need to do some further investigating of other phonies like Congressman Jack Murtha and John "I was in Vietnam" Kerry. John Kerry has never produced his medical records and was never treated for his "wounds".

How anyone can ask who this man is hurting is a little surprising. Look up the requirements for these medals on the internet and then come back an tell me that this man has not cheapened the medal, insulted all of the legitimate medal holders and diminished the brvery of our current members of the military.

I like the suggestion of having him serve time in the Naval Brig!

Well, ive been reading some of the comments and I think they all have some good points. Im in the USMC right now actually, Ive been deployed to Japan and now am stationed in Camp Pendleton CA. It does sting a little bit, but in a odd thing for me to think this but shouldnt we try to help him understand what he did and why it's wrong? I know what he did was wrong but can't we try to be the bigger man?
Yes he should be fined and then he will understand but dragging him through the mud...I don't know. I joined to protect the American people. No matter what silly things they do, the flag burners and the hippies. All of them. He needs our compassion and support. I would hope that now he will have a good understanding of the people he has hurt by what he did.
