A Deal Too Good To Be True?: Katrina Victims Say Mortgage Lender Misled Them

Thousands of homeowners devastated by Hurricanes Katrina and Rita are accusing their mortgage lender of recanting on its promise to suspend their mortgage payments in the immediate aftermath of the hurricanes.
In what they now consider a deal too good to be true, homeowners say Countrywide Home Loans promised they wouldn't have to make payments on their mortgages for three to six months.

From its corporate headquarters in California, the country's largest mortgage lender issued a press release about the offer and put it in writing to homeowners, adding, "Late charges will not be assessed."
"There would basically be a freeze on our payment, and our payments would be put on the back end," Donna Hellmer of Hammond, La., told ABC News.
Donna and her husband Andrew didn't make the payments. But then Countrywide sent them a notice of default, demanding the missed payments plus late fees in a lump sum, a total of $4,300 due in 30 days.

"They basically told me this was the deal, 'You pay the lump sum, or you're going to be foreclosed on,'" recalled Hellmer, who, along with her husband Andrew, had to take out a new loan to pay Countrywide and keep their home.
The story is one Chad and Rebecca Goodwin of Houston, Texas, know all too well.
They too faced foreclosure and are now suing Countrywide after capturing on tape what their lawyers say is an important admission by a Countrywide representative:
"What they promised me was that it would be tacked on to the end of my loan," Chad says on the call, according to the recording.
"A lot of people were told that, but it wasn't the case," the Countrywide employee says. "Unfortunately, what happened is we were hoping our banks would let us do it, and they wouldn't."

According to the Goodwins' lawyer, Jill Bowman, that is just a cover-up. "Quite frankly what happened is they decided not to keep this promise," she told ABC News. "I think because it was going to cost them money."
For the Hellmers in Louisiana, Countrywide's broken promise means paying $200 more a month than they were before Hurricane Katrina.
"They took advantage of people while they were down," she said. "They created more of a financial hardship for us than the hurricane did."
Countrywide has denied the allegations, and in a statement to ABC News, says it "has been diligently working with customers to develop individual repayment plans."

Well now, as bad as this all is I am sure glad that I'm not the only one! Countrywide had told us that we could do a forebearance to the end of the note and it would extend our mortgage an extra three months!! All we had called for was to get the address to mail our payment after Hurricane Rita. Had the money, should have sent it in-but-the employee kept saying," don't worry just take care of the things you need now; Countrywide is doing this for all their customers. Heck, I even tried to convince another lender to buy this mortgage and get us away from CW. Course that's not the way it works. Darn it!! So, for the bozo who says stop bellyaching, you need to keep your yap shut till you know what you're talking about. Hang in there everyone! Sooner or later we will get back to normal.

I am so sorry for all of that you endured dealing with Countrywide. From my experience with the 1994 Northridge earthquake, it can take years to recover. Like Barbara said, hang in there and soon things will be better. Sometimes it is hard to have faith or see better times. I saw a great magnet the other day. It said "if your are going through hell, keep going".
As for Countrywide, what goes around comes around.

Countrywide is all messed up!! I signed an FHA Loan & after the Katrina called HUD for asst. & was told I did not even have a case # with FHA. What did Countrywide do with Monies going to FHA & everyone I talked w/at Countrywide would think I had a FHA LOan but the workout dept. said just wait til the end of the suppension time and will work out an asst. program. It has taken me 2.5 yrs. to make someone understand. I had to miss out on help due to their incompetency. I have also had alot more difficulties w/CW I need to know if anyone has signed an FHA LOAN and found out later that they did not have one Please let me know!!

I also live in Houston and are going thru the exact thing, but Counrtywide went one step further with us- they referred us to a company that now has been banned to do business in Houston.

My wife and i went through the workout program with Countrywide when we fell behind. We where on the program for 18 month, no missed payments. We became les pendens only after initial 60 day default
before that. We became 60 days late because they cashed our check but then returned it. They then took 6 weeks to make a workout agreement.
When the workout ended, they demanded we pay the total defaulted amount. They agreed to a loan modification but sent the paper work the same day it was due back to them, so it was cancelled. These are evil people. Any class action to join?
I have since sold my home.

I also had the displeasure of dealing with Countrywide when the mortgage on our first home was sold to them by the brokerage firm we used (will never make that mistake again). Countrywide is most definitely the worst company I have EVER dealt with, bar none. Getting in touch with a live person meant waiting extreme amounts of time on hold (and sometimes getting hung up on after waiting). When you did get someone on the phone their attitude was horrible.
At one point during our period of torture at the hands of this despicable company we were assessed a fee on our mortgage for some type of "Shoppers Service". They claimed we had signed up for the service verbally through a telephone solicitation. Despite the fact that they could not provide one shred of evidence that we had ever agreed to the service nor any proof we had even spoken to anyone from the company selling the service (they couldn't even identify the date or time we supposedly signed up!) they still refused to remove the charges that had accrued. The ironic part was that they required a written request to cancel a service that was supposedly signed up for over the phone. Go figure!!
I hope Countrywide goes under and all of their hired hands, from the mailroom to the boardroom, loose their jobs and homes. As far as I’m concerned, unless they're being held in their cubicles at gun point, each and every Countrywide employee is an eager and willing accomplice in their employer's actions. Let them all go down the tubes together!

I can't understand how after seeing so much of this some state attny hasn't started checking into all of these aligations. There has got to be some truth to a lot of this and a whole bunch of other's in the same boat.

I am so shocked to find out all of this negative information about CountryWide. However I am not surprised. Though our situation is nothing like the Katrina victims have endured (and My heart still goes out to them) we are in the middle of a refinance with Countrywide. I have never seen such an emotional roller coaster ride as this has been. We signed our closing docs over 17 days ago and we have yet to be funded. WE have been waiting on a bank wire that has never been funded. I keep getting the run around and my family and I are so desperate to move on and get on with a new home purchase that they have cost us in the process. We have found another home to purchase but we need the funds on the refinance to do a down payment. We have passed our right of recision period and they don't even seem to care at CountryWide. WE have provided numerous documents to them since our closing per their request. I am thinking that now I may just find another lender. This company has cost us so much and placed false hope for a better future for our family. Does anyone know where I could turn at this point? I have been told by others that this is a lawsuit. Has anyone seen this process take so long. Thanks for reading. I would love to hear from you.

I feel this is a conspiracy between Countrywide and Foreclosure Assistance Solutions. They refer you to them, FAS demands that you do not have any comunication with COuntrywide. They take your up- front money, do nothing with your loan and Countrywide forecloses on your property. It does not all add up.

Countrywide is sneaky and absolutely unforgiving. When I got my "interest only" mortgage, I did not receive the first statement to pay my bill. I went online and tried to pay it. It told me I had to send a check in for my accountg numbers first. So, I sent that in, along with the registration form for online payments and the payment in the same envelope.
They had my old address on file, which is why I didn't get my bill. So I gave them the new address. The next month, I still didn't get a bill and again I went online. I still couldn't pay and they said they never received my voided check for the automatic withdrawl. (??? they got the payment though and they were in the same envelope??)

From everything I've read, Countrywide is unfortunately typical in their industry. They lie to people, then trash their credit and prevent them from going to another lender. The whole credit industry is a giant racket; it's impossible to get and keep an accurate credit report once one of these people have you in their sights. If there are honest operations, I have never heard of them. This is why I have not bought a house, even thought I could afford it.

I have been fighting a judicial foreclosure against countrywide for 2.5 half years now. Same story. Except in my case Countrywide made my insurance check disappear. Then when I complained because I did want to fix my damages all of a sudden I was 2 months past due. In one year I went from 2 months past due to six months and then they attempted to foreclose. Did I mention I made every single payment every single month and can prove it? Customer service? Couldn't even put together a balance sheet. True story check it out.

Oh and did I mention that Countrywide trashed my credit. My personal disaster happened in 2001. Countrywide did to me what they did to the Katrina victims. A loan modification agreement that added 6 months to the loan, plus $10,000 to the loan and for four years claimed I was behind on my payments even though I doubled up on the payments..... Seems I wasn't as alone as I thought. Did I mention I had a FHA loan? Does Mr. Mozilo have enough money left over after cashing in his stock options to pay for some of the grief and suffering he has put a lot of people through? Mr. Mozilo these are our homes. Our only homes.

Our payments were deferred also after hurricane Rita then in September 06 we received a certified letter demanding the payment in full in 30 days or they would start foreclosing procedures. I was 7 months pregnant at the time and couldn't believe we were about to be homeless with a newborn baby because they went back on their word. If anyone has any info on class actions PLEASE let me know.

I was told by Countrywide that I was "B paper" and could not get a good interest rate. But when my rate kept changing and extra charges were appearing, I moved on and found another mortgage co. The next Co. told me that I had a great credit score. I'm glad that I caught on before I signed on the dotted line.

Let me explain how it works. FEMA only gives so much time as a moritorium and then if it is not paid they need to foreclose. Once they are foreclosing they can add on the rest of the fees so they can try and get their money when they foreclose. Basically they did not hold up their part of the bargin and pay after those three months were up. There are stipulations involved, basically they have to hold up their end of the bargin too. As far as having to pay in one lump sum again it is because you let it go into foreclosure. Just because you were a victim of the hurricane at one time does not mean you can use that excuse forever and they are trying to run a business and eventually have to do something to try and get their money back. Finally they don't want the house they want the money they gave you to buy the house. The home is a liability. The money is how they stay in business.

Tt is alllll my fault for what happened in the mortgage world... I prayed for CW to go belly up and they did and took all the others down with them...!!!
Go ahead put the blame on me, but there were others praying too... Go back and read my 1st posting on Sep 19, 2007 7:50:34 PM... all I ever did was pay my mortgage... on time... every month and that still wasnt good enough for them...!!!
The word here is GREED... and I think everyone can read the handwritting that was on the wall back in 2007.. very clearly now... in 2009...
3-1/2 years after Katrina.. hubby and I are still living in an incompleted home... as I said before we owned more of it than CW did...!!! If I dont get a whole house again in this world... I know God is preparing me one in the next world...!!! Neighbors have given us furniture and folks have given us clothing... all appreciated... but it NEVER should have been like this...
