Senate Lawyers Reviewing Roland Burris' New Papers

ABC News' Tahman Bradley Reports: Assistant Senate majority leader, Sen. Dick Durbin of Illinois says Roland Burris' newly submitted papers to join the U.S. Senate are currently under review by lawyers to see if they comply with the body's rules.

"Late Friday, the secretary of state of Illinois, who had withheld his signature from a key document that the Senate has required for 125 years, sent a new document to the Senate. It's now being evaluated by legal counsel," said Durbin.

Even though the Illinois secretary of state has now signed off on the appointment made by embattled Gov. Rod Blagojevich, the Senate could still decide not seat Burris, Durbin said.

Durbin would not say when he expects the matter to be resolved, but did indicate that he expects the process to move quickly.

The next step for Senate leadership is to look at testimony in the Illinois impeachment hearings of Blagojevich, Durbin said.

"To wait until Gov. Blagojevich is removed could be a matter of weeks, I think Roland Burris' future and fate will be decided before then."

Meanwhile, Mr. Burris announced plans to come to Washington "in a day or two."

"All the documents have now been submitted… It is our position that those documents are now in compliance with the Senate rules, and therefore, after the lawyers have reviewed this, my attorneys will be in Washington on Monday to confirm with the parliamentarian and the attorneys to confirm that all of this is in order."

Both Durbin and Burris appeared Sunday on the CBS program "Face the Nation".

Why is the Senate lawyers looking at Burris' papers??? This whole Burris thing has become a racial issue and the U.S.Senate said long before Burris was chosen that 'the Senate would not seat any appointee by Gov. Blago'. Burris is not an honorable man - if he were, why did he accept this appointment from a Gov. with Federal charges haning over him? Burris is in this for his own EGO... pure and simple. Don't seat him and let the people of Illinois elect the candidate of their choice. By the way, I live in Chicago and I am a Democrat - but in this case, I believe it is time to do the right thing, even if a Republican wins the Senate seat.

Sandi-shut the f*** up, it's people like you that tries to destroy the charecter of others, there is nothing in this man past or in his record that proves that he is not an honarable man and for you to question his honor because he was appointed for a position by a sitting Govenor, who has not been indicted or charged with anything to this date, is ridiculous, let the process play out and stop the stupid insults, you people just have no lives, you are just intent on destroying the lives of others. You can't just change the rules when you don't like them.

Had "Blago" selected a white, left leaning male republican, would Sandi still have the same problem? How about a gay, hispanic woman? I suspect she would - even though it would not be as stinging to her - because she, like so many others, make decisions about following the law based upon how much she likes, or in the case of Blago, dislikes someone. However, Sandi, and so many of the "white" Burris opponents, are absolutely "checkmated", legally and politically, on the Burris appointment because the appointment is the sole province of the sitting Illinois governor as stated by the U.S. Constitution and Illinois statute and Burris is "black but qualified". But that's not enough authority for good citizens like Sandi. Sandi, you will will find some, but very little solace, in the inevitable removal of Blago via trial in the Illinois Senate. That is because, the new governor, now the lieutenant governor, will climb into his seat from that cesspool known as "Illinois politics".

Basically, after indicating that the appointment was illegal and would not be accepted, Reid and the Senate are attempting to re-establish the legality of the appointment.

It's like the "Wizard of Oz".

Although those traveling and seeking Oz already had what they sought,Oz had to bless them for credibility .

The appointment is legal but now it has to be made legal in the sight of the American public by the "all knowing, all encompassing "Oz"(Senate Rules).

Isn't it interesting, Sandi that a Burris supporter voices exactly why we in Illinois, and especially downstate Illinois, cringe at Burris being our new senator to replace Barack Obama. Just listen to him. He sounds exactly like the ignorant, reverse racist, Sara who replied so ignorantly and innanely to your comment. We don't want this element to represent us in the Senate and that means Burris has to go!!!!

Time has now come for Reid and his cohorts to eat crow. Since they are the law makers (remember it takes senate, house, and president acting in a state of checks and balances to create the law)in the first stage, they think they can also interpret it (sorry, ultimately that is the function of the courts). The Illinois state supreme court has already spoken, and I am sure even the U.S. will speak on the issue, because Burris is not going to let Reid to decide his fate. Also, once the Illinois governor, even though under some political and moral cloud, has legally nominated/appointed Burris, that would be still the fully valid legal document, no matter whether the governor is convicted later and then removed from his office. In short, it is not within the province of the succeeding Lieutenant Governor to nullify the action of his predecessor (without some kind of a court order)and then make his own selection. USA is a litigious country, and there is no dearth of talent to checkmate the wily action of Reid and his coterie. Is race also one of the factors in this drama? I believe so.

Blago actually has it right! All the seats in our government are for sale to the highest bidder. New York is selling Hillary's seat to Kennedy. Al Franken has just about bought the one in Minnesota. Obama paid the most for the seat in the white house with questionable contributions! They are all for sale. Why make such a big deal about it!!???

Those who keep on harping on this as a "race" issue are the same ones who have kept this country backwards for the last century. Right, blame everything on it race, and you have the answer. Nonetheless, there are millions of us still waiting to find out the real "cost" of this seat. Blago himself said it, not anyone else, and how are we to believe that it was for free after all? Everything has a price, and until the truth comes out, even if it is a blue candidate, he should NOT BE SEATED.

It's not about race. It's pure politics. The Democrats really want someone appointed who they believe can win reelection in two years. They do not believe Burris can win in a state that's currently not very happy with their Democrats. They do not want to lose that vote in the Senate because of a weak candidate.

I guess the hope is if the media doesn't...or refuses...to acknowledge it's all about party power politics, maybe the voters won't figure it out so Reid and Durbin can play their game and not look foolish.

Just as I promised, they will seat Burris because they have no case against him. He would win any court challenge and they know it. And so did Blago, who obviously did it to throw suspicion from himself and deflate the prosecution. I doubt this was accomplished. But at least if Burris serves honorably, some good may come of it. Time will tell.

You guys, you guys. You really need to spend less time saying that Burris shouldn't be seated when you obviously don't know either the law or your history. This has already been done before. Powell v McCormick. Adam Clayton Powell Jr was under investigation and not seated in the 90th Congress. He sued and won in 1969, 7-1. Congress only needs to verify that he is 30, US Resident for 9 years, and resident of the state. THATS IT. Nothing about "signatures" is found in Article 1 of the Constitution. Quit being a dupe. I know Blogo is corrupt, And this sucks...but don't violate the law to pretend you are upholding it.
