Prosecutor Sleeping With The Judge?

We had a question come across the transom today that, frankly, you don't hear every day: Can a man be executed if the trial judge was sleeping with the prosecutor?
Charles Hood is scheduled to die next Wednesday in Texas. He claims that his 20-year-old conviction for double murder is unfair because the trial judge and the prosecutor were having an affair at the time. Hood's complaints had fallen largely on deaf ears until recently. Legal ethicists have sent letters to the Republican Governor, and just yesterday the state's tough pro-death penalty Attorney General wrote a letter to the local DA asking that the case be "thoroughly" reviewed . The AG apologized to the victim's family for any delay, but said that he was acting to "protect the integrity of the Texas legal system."
A state judge is holding a hearing next week, and may well force the retired Judge and former DA to testify. We'll be watching...

I'm very much for the death penalty.
But if the facts turn out that the two were having an affair, the entire trail must be thrown out.
This would be true if it were a misdemeanor, but someone facing the death penalty?
How could anyone question this?

So the judge was screwing the prosecutore while the prosecutor was screwing the defendant? lol
No wonder 'justice' is a female. Just a whole lot of screwing going on! lol

Hmmm, put the McCain camp on it post haste. I understand they do a really thorough vetting in just under 45 minutes.
This would no doubt be the most comprehensive review of any Texas death row case in its entire kangaroo court history. While Alaska's state motto is drill, drill, drill, the Lone Star state's has always kill, kill, kill since Governor George W. Bush was in charge.
